There are rare exceptions, but whether you file a waiver, or a waiver AND an I-212 you simply get a waiver in return. That's why I tell clients to wait. Its an extra $930USD for the exact same waiver.

DNA collection at this point could only be used to solve cases where DNA is evident, like sexual assault. Refusing the DNA? I have no idea what would happen but they are only doing to a few clients, although I don't have exact figures I would say 1 out of 10 report it to me. Not everyone calls me afterwards though, so perhaps the number could be higher.
Concerning biometrics does anyone know what happens if you refuse the DNA swab since it’s my understanding, from the reading I’ve done, that it’s not always necessary and really is a grey area in terms of the legality of them requesting it and it seems to not be requested from everyone getting biometrics.
Anybody here have any idea what happens in this instance? Do they just refuse to process your application?
In most cases, yes. But there are exceptions. The problem is to have something in writing. So you apply for a waiver, if they want, they can give you a SEPTEMBER LETTER, and then you no longer have to re-apply.
Sometimes I get clients who are given conflicting information. I send them to Niagara Falls. They make it clear they are there to simply ask for information, not to enter. Usually it is made clear if they need a waiver or not.
