There are rare exceptions, but whether you file a waiver, or a waiver AND an I-212 you simply get a waiver in return. That's why I tell clients to wait. Its an extra $930USD for the exact same waiver.

@JMarie - I still have not heard back and I have not inquired. I'm disappointed because I feel my case is very straightforward and I keep seeing July waivers being approved when I submitted my biometrics on June 30th. I was denied entry in March 2020 due to a criminal conviction that occurred more than 25 years ago - possession of stolen property over $5000. I was an occupant of a stolen vehicle and was basically just out for a joy ride. I then breached probation because I didn't complete my community hours in time. Since then, I have completely rehabbed and live a very normal life with a great job and family. When I was denied entry the border guard assured me the waiver would be easy for me to obtain. I'm just anxious to have this over with and approved and I'm curious what time frame they will approve me for. I'm glad this forum exists to see other people's stories and see the timeframe they are working on!
@skumar Hello. Congratulations on the 5-year waiver and thank you for sharing your story. My situation is pretty much same as yours. I had a document misrepresentation when i applied for F1 visa more than 10 years ago. I'm planning to apply for a waiver(TN/Visitor) soon. @LKand `That means you got job offer and then you went to the border for your TN approval without waiver and then you applied for waiver`
I got job offer but I did not go to border for TN approval. My future employer has petitioned for TN visa with USCIS. (I think this is similar to how employers petition for H1B for foreign citizens. For us Canadian citizens, they do not have to go through the H1B quota and all and hence is advantageous to them.)
So, after my petition got approved for 3 years, they sent me the I-797 forms with the TN approval. I used the same to apply for my waiver. That is, I put the approval obtained from USCIS Vermont Center as part of my package. Thanfully, I received the waiver for 5 years with the option to apply for TN visa.
1 YEAR WAIVER
Non criminal - immigration issue.

Yes, I got the job offer first and then applied for waiver.
I will say that I am very very fortunate that the company has been willing to wait for my waiver application to be approved.

Technically yes. My guess is that it will impact the waiver. Lately as well, I have noticed a shift in people being told impaired is an issue.
The proof will be in your results though. I am particularly interested if it will impact the waiver because I had a recent client who I told to wait because they had a 2020 impaired on top of their old record.

I've recently submitted my waiver applications (I-192 & I-212 July 7th) and I'm noticing a lot of responses from around this date. That's exciting and congrats to all that's been approved!
QUESTION: I do have a 2021 DUI conviction on my record and am wondering if that will affect my chances of being approved even though that particular offence doesn't require a waiver?
