Post real application stories here. Not "A guy told me" or "a few of my clients" but specific client experiences so others can see accurately what is happening.

There are rare exceptions, but whether you file a waiver, or a waiver AND an I-212 you simply get a waiver in return. That's why I tell clients to wait. Its an extra $930USD for the exact same waiver.

Sorry, that was meant for the response below

Sorry June 14th, not 16th.

Replies (recent first):

I finally finished the e-safe forms and downloaded all required documentation, (personal letter, rcmp , references etc)
I didn't get any prompts to submit and pay the fee.
Did I miss something or do they contact me by email.
thanks

@neats47 i know the feeling I had to cancel two trip for work, I still had a long wait since ARO got my files only mid December

Kev replied 1 year ago   #551

@casper I haven’t heard of that during my countless researches on the process but it sounds like you created the account and was uploading documents in the mean time? I am collecting but haven’t created an account since I’m not ready to make the application yet.

DT replied 1 year ago   #550

@neats47 did you go to the courthouse directly or called in to inquire? You may hear from them soon and may not miss the cruise. I had a cruise booked and canceled because I didn’t tell my girlfriend that I was turned away from the border previously. It was with Royal and they offered a voucher that doesn’t expire. I really hope you get the waiver. Is it a difficult case he has or simply? I can understand how you feel. We are all at their mercy when that time comes aren’t we. Let the forum know how it goes.

DT replied 1 year ago   #549

@DT it was requested December 2. We sent it back right away (Dec 5). I think what bothers me more than anything is that when applying for the waiver, you are totally and completely at the mercy of the USBP. Short of begging, all you can do is submit what they ask for and hope for the best. It’s just really starting to get me down. We are missing out on a two week cruise in a few weeks because we don’t have my husbands waiver yet. And that’s if he gets it. Our hands are tied for now.

I've been working on my waiver over the past while constantly updating my personal letter and including the RCMP prints and adding letters of reference and was surprised I got an email saying I had 10 business days remaining to submit and pay the processing fee. I wasn't aware there was a time line except for the one for 45 days to report for biometrics after payment.
Anyone know if there are any consequences for not making this deadline?

casper replied 1 year ago   #547

@neats47 yes this can be very frustrating. I hope you hear from them soon. When did they request the information?

DT replied 1 year ago   #546

@kev august 14… they have requested more information which was sent in dec 5… our court in Stratford Ontario doesn’t keep records 30 years old. Very frustrating.

neats47 replied 1 year ago   #545

@neats47 when did you applied for your waiver? I also manage to get court record in Quebec that was 26 years ago but maybe was accessible because that was youth court

@Magnus I wasn’t a Canadian citizen and had a visitor visa. I don’t know how it worked really. They canceled my visa and barred me from entering for 5 years. When I became a citizen, I was told that I would need a waiver but I would need to wait 5 years.

And lol I feel like they’re getting slower and slower. I heard they would take over a year with the paper so for esafe to be taking so long is worrisome.

SarahB replied 1 year ago   #543

Thanks for the reply @SarahB.

I haven’t filed an application yet. I had an overstay from about 6-7 years ago and I’ll probably file an application this year. Seems they’re taking longer these days so hopefully by the time I file mine it won’t be a 6 month wait. Lol.

If you overstayed for 6 months how’d they ban you for 5 years? I thought that was just a 3 year ban and if you overstayed a year or more it’s a 10 year ban.

Magnus replied 1 year ago   #542

@Magnus I needed a waiver because I overstayed by 6 months. This was back in 2012. My ban was five years. I waited an additional 5 years before applying.

Do you have an application pending and if so, what are your circumstances?

SarahB replied 1 year ago   #541

@SarahB super congratulations and 5 years on top of it! That’s awesome!

May I ask what you needed a waiver for and how long ago was your ban from the US?

Magnus replied 1 year ago   #540

My waiver is here! 5 years first time applicant. I’m so excited!

@J Rogers @JerryT congratulations on your approvals. I hope mine show up soon. Soon they’d be into September waivers so I’m keeping my fingers crossed since I submitted August 31st.

SarahB replied 1 year ago   #538

5 year waiver. This client had a waiver as a landed immigrant, (very unusual) for 1 year and this was a re-application for him, first time he had dealt with me. He was a misrepresentation case, where the lawyers doing his paperwork for visas had really made the mistake, not him.
Note like JerryT (above post) he went to the border August 31. Congratulations to both people.

@Magnus
My TN valid for 3 year, but my waiver is 2 years

Nathan replied 1 year ago   #535

@Nathan why was your TN visa only for 2 years? It’s a visa for 3 years that can be renewed indefinitely. Just curious as to why yours is only 2 years.

Magnus replied 1 year ago   #534

@Joe
My first waiver was B1/2 1 year and second one I specifically asked for TN and granted me for 2 year (with TN), I have attached my degree certificate/transcript and a letter requesting for TN to work in US
