Post real application stories here. Not "A guy told me" or "a few of my clients" but specific client experiences so others can see accurately what is happening.

There are rare exceptions, but whether you file a waiver, or a waiver AND an I-212 you simply get a waiver in return. That's why I tell clients to wait. Its an extra $930USD for the exact same waiver.

I'm so happy to post this.
This is my 4th waiver application,
1st time denied, not enough time passed since sentence completion, 2nd time 1 year waiver, 3rd time 1 year waiver, 4th time 5 year waiver.
This is the first time I used outside help, I used John to rewrite my letter and he made a few other suggestions including putting more effort into reference letters which seems to have helped.

I submitted my info on Jan 20th and got an email this morning to let me know the status has changed on my application.

I used John to file my application so need him to send me the decision, hopefully it's a 5 year waiver.

Just a comment on the post I just made...

I should add, sexual assault offences are not condoned. I don't believe he should get a waiver because he didn't do anything wrong, simply in comparison to other applications. The reasons they said "no" were flimsy compared to other applications. "to drunk to give consent" is STILL rape/sexual assault.

When I comment on waivers, I am speaking on strategy ONLY. I truly believe that victims of sexual assault rarely find real justice. I do hope when I advocate on behalf of my clients here, I am not triggering anyone. If I do, or appear insensitive, please contact me, or feel free to call me out. My client is a real human being, and so is the victim. No one should slut shame or victim blame, and if I ever appear to do that, I should be held accountable. I encourage anyone to feel free to comment on anything I say, without being attacked.

Sexual assault waiver denied

This is a terrible denial. More of a "she was too drunk to give consent" he confessed, 1994 -90 days intermittent and 1 year probation.
He has targeted counselling and they hinged the rejection on "not targeted enough" and didn't like that we used the word "attempted" to enter the victim when he did in fact enter the victim. We said all the right things about feeling empathy for the victim, etc. An impaired in 1991 is the only other conviction.

I am encouraging the client to appeal, which I do for free, he just has to pay the $110USD fee.

I read a lot of these, and this is FLIMSY.

Has anyone ever applied for a B1/B2 and only received one of them? How will I know which has been approved if I receive a waiver?

@PAH Assumijg you are a Canadian citizen, why do you need H4 EAD. Just apply for TN when you have a job.

I will guess that H4 does not mean H4 EAD.

Received waiver on June 2nd. Submitted the waiver on Jan 17. My waiver application says ‘can apply for H4 visa’. My question is can I apply for H4-EAD as well as it doesn’t mention H4-EAD explicitly? If anyone can advise on this, it would be very helpful for me. Thank you in advance.

I received an email that there is a change in my e-safe application and have 30 days to download my ARO.
I log on to my account and don't see anything to download.
Where am I supposed to find it? Under "my forms" ????

it looks tike the most recent waivers are coming in around 4 months plus 8-12 days.
I submitted mine at the border Jan 18th and like you I'm hoping for the next couple of days.

It’s been so quiet since the past week for waivers. I went to the border on Jan 17th but still waiting. Just curious to know if anyone got the waiver after Jan 11th.

Bad day for Denials. Trafficking in 2016 cocaine - 30 months.

Note the date he went to the border. The same time it is taking to process waivers that are granted. Much different than the one this morning. I am not exactly sure what this means, since it takes much more time to write out a rejection letter than just grant a waiver.

@J Rogers oh wow. That wasn’t wise at all. But oh well. I guess they do random vehicles checks at the border. Mine wasn’t checked.

WAIVER DENIAL

Client had a 2012 Fraud, but mitigating circumstance is when he went to the border to process the waiver, he was caught with 3 joints in his car of marijuana.
Unfortunately, this seems to be the main basis of the refusal.
Below is his timeline. Notice how it is much longer than when waivers are granted. He went to the border November 17, while most waiver are now being granted by people who went to the border in January (10th)
