Post real application stories here. Not "A guy told me" or "a few of my clients" but specific client experiences so others can see accurately what is happening.

There are rare exceptions, but whether you file a waiver, or a waiver AND an I-212 you simply get a waiver in return. That's why I tell clients to wait. Its an extra $930USD for the exact same waiver.

@Tiffany I’ll probably apply in June/July and possibly use one of the experts on here to do the application although I imagine it’s not terribly difficult to DIY it might just be sensible to get it done right the first time by someone like John.

@Kev you have 30 days to print the waiver and you can save it on your pc etc. if not, you have to pay for them to reissue it again I assume (john can confirm since I’m not sure so speculating on the latter). I’m responding only because your comment/question to John got bumped so he may not have seen it and more or less to share the little I know

@W yea it was only a three year ban for me and it was applied after the fact (many months after I actually did the misrepresentation)
I think I had a few things going which I was able to make clear in my letter and my lawyers letter
- the misrepresentation happened only a few days after my employment ended. I legitimately believed I was entitled to cross under a TN under the 60 day grace period (which was wrong because that only applie if you are already state side)
- I had another TN visa almost ready to go
- significant residential ties in the U.S (I lived there)
- employment by a major U.S company
- no criminal bg

Refused charges

In both cases it was not deliberate. One of the clients actually already HAD the waiver when he disputed the charge. The credit card company called them and said there was suspicious activity, and without making sure, they told them to refuse x amount of charges. Also, its not "$585USD" that gets taken, its "$784.54CDN" or some weird charge, so they don't RECOGNIZE it.

@J Rogers do people really think they can get away with doing something like this. They’re probably not desperate for a waiver. Any update on what you wrote two days ago about the new look on the waivers? Do you think there is an issue Or glitch somewhere maybe

I thought I was going to post another waiver, he went to the border on November 8th and got an email. Unfortunately. he disputed the $585 charge on his credit card. (long story)

So they have closed his file. Now he has to pay $585 for the closed application as well as $585 for the NEW application. You are paying Homeland Security for their TIME. Frustrating for him, but this is the second client that did this.

@CoffeeCrisp can I ask how long was the ban for the misrepresentation? I thought it was 10 years and many waiver people I spoke to say that you should wait for about 40-50% of your sentence to pass before applying for a waiver. I also waited a long time after submitting the waiver but was denied (long waiting time seems to be an usual indication of denial) so it’s nice to see that someone got it even just after 2 years of waiting. Like you said it might’ve been very borderline but I’m glad you landed on the right side.

@J Rogers i am confuse, what do we need to do after getting the waiver approved?
You mentionned a client had a 10 days warning otherwise he would need to go at the border again and pay 465USD for a replacement

5 year waiver. Re-application, he got a 1 year first. Now look at the dates. He called me because his wife reminded him and he had JUST gotten the 10 day warning...last FRIDAY!!! He was almost at 30 days. What does that mean? You have to pay $465USD and you have to apply at the border for a replacement.

Wow! Congratulations to those getting their waivers. I’m sure the waiting for the approval of the application can make a person really anxious.
It seems waivers are taking 4+ months to be adjudicated now. Hopefully it doesn’t get longer. Fingers crossed. I guess I should submit an application in June just to be safe as I hope to travel by Xmas.

@skumar thank you. I’m very thrilled with the results and yes, there are some downers and fear mongers in the industry. I’m glad I didn’t listen to them and even more happy to have put my trust in John. Even if I got a one year, I would have been happy because I would have gotten what I paid and hoped for.

@CoffeeCrisp, congratulations on getting your waiver today. I can’t wait to make my first trip back.
