Post real application stories here. Not "A guy told me" or "a few of my clients" but specific client experiences so others can see accurately what is happening.

There are rare exceptions, but whether you file a waiver, or a waiver AND an I-212 you simply get a waiver in return. That's why I tell clients to wait. Its an extra $930USD for the exact same waiver.

5 YEAR WAIVER - SEXUALLY BASED OFFENCE. So the waiver DOES say "you might have to report to local law enforcement in certain States."

But overall, 6 waivers COMPLETED with sexually based offences, 3 were granted, 3 were not.

2 WAIVERS. ONE DENIED.
The waiver was denied because the person had a $300k + restitution, and as I explained, the US would want to see it paid. It is clear to me that the client gave his house to his children, as a way of avoiding paying the restitution. Anyways, you cannot just say "they took my house", without proof, and assume they will give you a waiver.

The bottom one is a client who had a 5 year, and this is his re-application. I told him to do a drug test/doctor letter (one of these) and he did not. He still got the 5 year waiver. He has a past narcotics conviction. I still strongly advise people to do the drug test or doctor letter, but in some cases obviously, it does not matter.

I like to be transparent when I post, because although I am an expert, I am not always right.

You are back to "normal", you just have to show the Waiver. (Both pages) 180 days out of a calendar year like everyone else, although I would absdolutely be very very careful if I have an overstay and keep my visits shorter for now.

Just got approved for a 1-year waiver. Applied through e-safe. Didn’t find this blog/thread until after we applied or we would have certainly used your services.

Submitted the application 9/22/2022. Approval received 1/26/2023. The situation was an overstay during the Covid border shutdown of greater than 180 days but less than 1 year. 3 year ban.

This thread really gave us hope as we were following along. Thanks to all who post (especially J Rogers) and best luck to those still waiting.

J Rogers, any advice on the first entry into the US? Land vs. air travel? How long can we plan the visit for?

@J Rogers is it usual for someone to get a 5 year waiver on the first attempt for an overstay such as this client here or did the fact that they were fleeing Haiti factor into some sort of “compassionate” adjudication of this person’s waiver? Or in this case was living “illegally” somehow seen as different than an “overstay”?

@KatM I have been advised that I need a waiver even though the ban is up. I was told that I definitely would need to keep applying if I want to travel to the US.

5 year waiver

Fled Haiti in 2001 with fake documents. Lived illegally in the US for 8 years. First attempt at a waiver.

@Magnus I needed a waiver because I overstayed by 6 months. This was back in 2012. My ban was five years. I waited an additional 5 years before applying.

Do you have an application pending and if so, what are your circumstances?

Yes, your case is interesting. Can you give more details? You had a 5 year waiver, but because it was not just "business and pleasure" and contains multiple possible visas, they have only given you a 1 year? Are we understanding you correctly? I am curious because I have had to sometimes do waivers for clients before the 5 years because they suddenly want to add a TN or other designation to it. ("O" visas are popular for music) But in these cases, the person still got a brand new 5 year waiver.

I am very curious about the difference.

@commander congratulations. I’m curious as to why they went from 5 years to a 1 year waiver. Did you do something different when you submitted your application? Have you been submitting the same documents or has something changed in your circumstances?

Just got my waiver approved. This is my third waiver. I had a 3-year bar due to overstaying more than 6 months but less than 1 year. This waiver was given for 1 year however it contains multiple purposes/visa types, not only B1/B2. My past waivers were 6 months, then 5 years. See the dates below.

@J Rogers sorry, I believe my question wasn’t quite clear. What I mean is let’s say there is a misrepresentation and one is denied entry, do they just deny them and they can try to cross again or do they simply ban them for a period of time. Now if there isn’t a ban like you said it depends, then I assume they tell them they need a waiver because of the misrepresentation and that’s that.

It really depends. And in many cases it doesn't matter anyways because if there is a ban...you still can apply before its over. If its a 10 year ban, I have had clients get waivers after 5 years for example. The time that has passed is more important than if the person has a ban or not.
