@J Rogers so she applied for a waiver without being convicted of a crime? Makes no sense. What was your advice to the client when she decided to apply for the waiver? I’d like to hear more on this because you post all the time about how important it is to wait until enough time has passed and also not applying if you don’t think you’d need a waiver.

No waiver granted, but here is an example of someone who is actually up on charges, and they requested further proof it is done. She has her court date next week and says she will beat the charge.

Hey guys I got a happy update. I posted here maybe 1.5 years ago (don't remember my username) about my situation: I left a few THC pills in my backpack in early 2021 while crossing and I only realized when I got to secondary so as a result I got a ban and my TN visa was revoked. I submitted a waiver application in june 2021 and again in dec 2021. Both applications were denied with boilerplate reasons which was very frustrating. I decided to get a lawyer for my third attempt in Summer 2022 around May and he helped me craft a good personal letter and he also wrote what I think was a good legal analysis of my case as an addendum to my letter basically stating that my two previous applications were not given the correct rigorous analysis from the adjudicator, especially since I don't have a criminal record. I was quite worried that I would have to wait 5+ years to have a shot.

Anyways the good news is I just got my waiver approval today for three years for TN and H1B visas (plus the usual B1 visa). I couldnt be more happy to get all this over with. I don't have the application timeline since it was done through a lawyer but I submitted my application at the border in June so this went up to a supervisor.

Moral of my story is sometimes it seems like the process is just a crapshoot...which makes sense b/c adjudicators are just people as well. But definitely put in effort in your personal letter and if you think your case is borderline then it's probably better to get some pro help

1 year waiver approval! Undocumented status from ~2007-2018, no crimes or convictions. Voluntarily moved to Canada in 2018 without ever being in deportation or immigration proceedings. Applied for a visitor visa in 2019 but was denied due to 10 year bar, which will expire in 2028.

5 year waiver My first March waiver and they are my first "went to the border in November" Waiver. November 1st.

9 convictions 1997-2015 out of trouble 7 years. He got a 1 at first and now has a 5.

September Letter!!!

First application. Fled Russia many years ago, went through Mexico and illegally entered and was caught in Texas. Before there was a hearing, fled to Canada. She is a member of the LBGTQ+ community so was granted asylum on that basis in Canada.

Conspiracy to traffic in narcotic 1990 4.5 year sentence. But its a re-application and he had a 5 year waiver already. Much slower than expected.
