Post real application stories here. Not "A guy told me" or "a few of my clients" but specific client experiences so others can see accurately what is happening.

There are rare exceptions, but whether you file a waiver, or a waiver AND an I-212 you simply get a waiver in return. That's why I tell clients to wait. Its an extra $930USD for the exact same waiver.

I got my appeal returned from May and the good news is that the judge outlined their support in the decision to grant me a waiver. The bad news is that they remanded my case back to the director that denied me, instructing to get consistent with their decision.

Is this because the DHS needs to do their checks since it’s my first waiver? Does this go all the way back to the currently 120 day wait time?

Just curious if you had much experience with appeals and can advise!

@J Rogers I consulted with a certain immigration company (you definitely know who) who told me my case was more complex than someone with a gang/drug/murder charge so they have to charge me 8k for it… but I can’t apply for 2-3 years. I called bs on that because my ban was 5 years and my chances of success will shoot up after 2-3 years anyway, and like you said it matters much less what’s written in the application then. They wanted me to hire them about 1.5 years in and my feeling is that they will drag the paperwork out until I have a good chance of getting it. It was so shady.

@veneey the reason was insufficient documentation/unable to overcome presumed immigration intent. They thought I was going to work/get married there.

1 YEAR WAIVER - first time applicant.

2005 Washington – Trafficking Marijuana
so this is a truck driver who did not know he had a secret compartment on his truck full or marijuana. This isn't uncommon. He is basically working for a trucking company and it isn't HIS truck. 260lbs of marijuana.

Time is USUALLY the biggest factor. I could write "because my clients favorite color is blue, they should get a 20 year waiver immediately" but it doesn't matter what I say. The truth is most waiver rejected are because "not enough time has elapsed".

To answer the question about the client who is up on charges that I posted, they applied because of a previous record, easy waiver. Once the application had been filed, they were charged. I would NEVER apply for a waiver while charges are pending.

@Marsha i agree I did lots of research as well before asking questions. If that would be possible I wouldn’t care to pay extra to get that quickly since that cause problem with my job but only patience work. At least when I see some person with a criminal record longer than my arm I’m confident I’ll get it.

But on the other I don’t blame him to ask some question for some situation that can be very stressful, sometimes for some persons their job can be in jeopardy.

@Kev 😂😂😂😂😂😂 Me too. I’ll say this, I found the forum last August and I went through quite a bit of posts before I asked a question. My reason was because I didn’t want to ask a question that was asked and answered prior. A lot of people would do the same but still make a new posts asking the exact same question, not to mention those who asked the same questions repeatedly but don’t think other users would notice.People tend to abuse things that are free. If there were a fee to make new posts, many people would put more effort in looking for the information they seek in someone else’s post and not just throw repetitive content out there. Often the answer is there, we just need to spend a little time looking for it.

@Cdncta yes it does. You’ll get your waiver in half the time, I guarantee you. Don’t listen to all the people on here who have paid lawyers the big bucks and didn’t even get a waiver, and certainly don’t pay attention to the really successful ones who have used the experts here and the DIY applicants like me who has gotten a 5 years waiver. Get your hot shot lawyer and don’t forget to share your awesome news, how much you paid and even the name of the big shot individual/company.

Hm ok that makes sense. My lawyer's letter did explicitly mention that time is not supposed to be a factor and only the seriousness of the incident + risk to the country is supposed to be considered. But idk maybe I just pattern matched what he said with what I believed. Maybe it was just a matter of time since more than two years did pass

@veneey I’m glad you got your waiver. However I think it’s a combination of quality of your application plus the passage of time that dictated success. Time/recency to my understanding is probably the biggest factor even though there isn’t supposed to be a minimum wait time. For example if you had the world’s best writer doing your application they would still deny you if you tried to apply after only a few months just out of their principle. I was told by my lawyer that there was no minimum wait time and it should be a slam dunk since i have nothing on my record so I applied with a grovelling and remorseful letter after < 3months, and it was denied with the main reason being I reapplied too soon.
