Handing in Waivers -Quarantine and timelines - Post here

Post real application stories here. Not "A guy told me" or "a few of my clients" but specific client experiences so others can see accurately what is happening.

There are rare exceptions, but whether you file a waiver, or a waiver AND an I-212 you simply get a waiver in return. That's why I tell clients to wait. Its an extra $930USD for the exact same waiver.

Sorry, that was meant for the response below

Border run today.
Went over at Ogdensburg NY bridge.
No secondary check, passed us in with some questions on where we were going and for how long.

On way back into Canada no issues as well. Though I didn't expect any but hey.

They asked my partner about her job and our relationship. They even went as far as to ask me about the nature of my crime committed.

However this doesn't seem like the norm after hearing other peoples experience, but it appears I just have a tendency to get harassed by border officers...

@SouthernBBQ I’m sure they don’t have a specific list of questions they ask each person. They ask based on your circumstances so for example, if you drive to the border, they may ask who owns the vehicle. They ask what’s the purpose of your trip and how long you plan on staying.

SarahB replied 1 year ago   #813

@marsha @kiwi @t raptors
Thanks for that. What sort of questions do they ask you or spouse?

SouthernBBQ replied 1 year ago   #812

@SouthernBBQ it took me about a half an hour there. There were no cars in the line up but we got to the inspection booth, the officer couldn’t find me in their system. He was speaking to his colleague and told him it’s really weird. “She is Canadian but I have no record of her needing a waiver. She has one.” His colleague said to him to send me upstairs if I need the stamp or simply let me through. The officer sent me up and I waited about 5 minutes before I got called. The officer upstairs had my records however. He said to me it’s been a while since they’ve seen me (since 2013) and explained how the waiver works, told me when I should reapply and sent me on my way. They didn’t speak to my hubby.

They questioned my partner when I went in secondary the first time with my waiver

T Raptors replied 1 year ago   #810

@SouthernBBQ

If you are driving across, they will send you inside to secondary, depending on the line in there, it's usually only 10 minutes or less.

They give you a 6-month entry I194 document and you pay $6.00US

I have crossed with my wife on a first time on a new waiver and both are required to go in but they didn't talk to her.

Kiwi replied 1 year ago   #809

Do you need to set aside a ton of time for your first crossing at a land border? Is it safe to bring family with you?

SouthernBBQ replied 1 year ago   #808

@christinadwillow I applied late December and 🤞🏻I’ll get response within 3-4 weeks

Kev replied 1 year ago   #807

Hi, are there newer applications sent in? Like for example late December 2022/early January 2023?

christinadwillow replied 1 year ago   #806

@SouthernBBQ congratulations!! I’m very excited for you! We were all in the waiting game together so I’m thrilled for you!!! 💃🏿 💃🏿💃🏿 Kev, you’re up next!!!!

Got it! 1 year waiver, 234 days (8 months) credit card fraud charges 2004 conviction 2010 or so.

First time applying, did it with All Cleared(insert mostly myself), what a mistake that was. Will use John for a renewal.

Damn was it hard waiting and chewing my fingers. I'd asked for an update twice, got a reply once and none the second time. Thanks to John Rogers for dealing with my impatience.

I guess I'll apply again in four months in case it takes 8 months again?

5 year waiver - longtime waiver client, multiple waivers before.

Notice it is 4 months exactly from the visit to the border.

@FeelingHopeless good for you Im glad that finally work out for you. I just passed the 3 months mark hopefully will hear from them soon

Kev replied 1 year ago   #801

@FeelingHopeless congratulations on getting your waiver. Slow this past week on here

Tiffany replied 1 year ago   #800

@KatM thank you!

@BM
When I got the denial via e-SAFE, it outlines at the very end that there is an option to appeal by submitting to the ARO. It costed $110. Although I understood that it was rare that it would ever lead to a different outcome, I needed to leave no stone unturned… my career depended on it and the sole incident occurred all the way back in 2015. I had to try. I did this back in May 2022.

I went down the rabbit hole and learned that it could take up to 18 months to get a response back so I decided to start a new application in the fall.

Both ended up in the same hands anyway and I finally got a positive response on my appeal dated March 3rd, 2023!

There are three possible responses: the office sustains (approves), dismisses (denies), or remands (returns) the appeal. In this case, they remanded it back to the DHS office to properly review the case and appeal again, granting me the first waiver!

Hope that helps!
Can’t tell you how happy I am!

Thanks for the phone chat too @J Rogers !

FeelingHopeless replied 1 year ago   #799

@BM every lawyer i’ve spoken to told me this but all said it takes very long (like a year) and will cost a lot. One said he needs a retainer to bill hourly.

So I’m also very interested in hearing about @FeelingHopeless’s experience. Congrats btw!!

KatM replied 1 year ago   #798

@FeelingHopeless

Would you be able to elaborate on how you appealed? I wasn’t aware there was an appeal process for discretionary waivers.

BM replied 1 year ago   #797

@J Rogers I’ll give you a call later today.

@SarahB I finished my conditional sentence the month after the decision, which ended up being the same month I appealed.

In response to my own questions……. I got my waiver for 6 months this morning!!! I can’t tell you how happy I am and this forum got me through the last month of anxiety! So thank you all!

With the wait time, I’m going to process the next application right away!
