Post real application stories here. Not "A guy told me" or "a few of my clients" but specific client experiences so others can see accurately what is happening.

There are rare exceptions, but whether you file a waiver, or a waiver AND an I-212 you simply get a waiver in return. That's why I tell clients to wait. Its an extra $930USD for the exact same waiver.

@Kev it looks so. I decided to do my application for myself because I believe it’s doable. The exchange rate is very crappy and I just found it expensive in the end to pay the consultant fee and the hefty processing costs

Why? This is a couple, overstayed.
HUSBAND
1999- APPLIED FOR ASYLUM
1998- ENTERED THE US
2000- ASYLUM DENIED
2003- APPEAL DENIED
2003-2010- STAYED ILLEGALLY AND THEN CAME TO CANADA

WIFE
2000- Arrived in the United States at Chicago
2001- I applied for asylum
2004- asylum was rejected
2010- appeal denied

5 year waiver first application.
10 convictions over a 16 year span. Last one was 2008 Produce a Scheduled Substance (marijuana grow op)

@J Rogers i found out that if you also need a visa (business visa in my case) then you have to get a waiver via consulate.. cant get esafe waiver n use it w visa

I avoid any waivers not done the standard way, because the Consulate is TERRIBLE. I hate dealing with them.

@J Rogers wow 3 years that’s crazy. Can they just abandon and reapply via esafe at that point?

So I actually got a different email back from them recently instead of the boilerplate. They said my file couldn’t be found and to contact the agency I applied at. As I posted in another thread my waiver path is a bit different - it’s via a consulate recommendation. Turns out they can’t release info via email for that path even though they are also the ones adjudicating it.

Not very helpful but at least it shows there are real people behind the email actually doing checks on your inquiries. They just can’t tell you much.

Appeals are tough, but I posted an example of a woman who won her appeal. They argued not enough time had elapsed, but the appeal judge said that Covid had caused a delay in her case, so therefore it was unfair to take the date of her conviction and not the date of the actual event.

This is an upsetting rejection.
Sexual assault, claims he didn't do it, and had a lot of evidence that he used at his trial. He also has letters of support from people who were there, current ones. They have designated him a tier III offender.
We applied under Obama and got him a 1 year. Then under Trump, they refused him (like all sexually based offences under Trump). I thought for sure they would give him one now, but not the case.

They have the BALLS to make this about "lack of targeted counselling" when very few people who claim they are innocent, then need counselling for an offence they didn't actually commit. Tier III offender? That is ridiculous.

Anyways, I think we will appeal.

Now that it is done through e-SAFE, the email is essentially useless. It was a tool that had it uses when you were worried that the waiver was lost in the mail.

Now? They know its not completed. They aren't checking your file when you email. I have a client who sends emails religiously every month since April 2022. No answer, same email every time.

The email is just a way for you to feel like your "doing something". I have a client, who I am pretty sure may never get an answer, he has been waiting 3 years. He did NOT use e-SAFE. He was friends with member of a bike gang. Every month, email. Every month, same response.

So in light of THOSE 2 examples, waiting even 200 days seems pretty minor. Just be patient.

When I applied for my waiver the email I got from ARO mentionned wait 120 days before requesting a status request, but after emailing them I received an auto reply mentioning they don’t answer if it’s less than 150 days.

Any idea on this?
