Post real application stories here. Not "A guy told me" or "a few of my clients" but specific client experiences so others can see accurately what is happening.

There are rare exceptions, but whether you file a waiver, or a waiver AND an I-212 you simply get a waiver in return. That's why I tell clients to wait. Its an extra $930USD for the exact same waiver.

I got job offer but I did not go to border for TN approval. My future employer has petitioned for TN visa with USCIS. (I think this is similar to how employers petition for H1B for foreign citizens. For us Canadian citizens, they do not have to go through the H1B quota and all and hence is advantageous to them.)

So, after my petition got approved for 3 years, they sent me the I-797 forms with the TN approval. I used the same to apply for my waiver. That is, I put the approval obtained from USCIS Vermont Center as part of my package. Thanfully, I received the waiver for 5 years with the option to apply for TN visa.

1 more question. You mentioned that TN petition approved for 3 years. That means you got job offer and then you went to the border for your TN approval without waiver and then you applied for waiver? Thanks in advance.

Yes, I got the job offer first and then applied for waiver.

I will say that I am very very fortunate that the company has been willing to wait for my waiver application to be approved.

I was afraid of that and it didn't dawn on me until reviewing the information on this forum. I'm hoping it'll be a quick response either way and I'll definitely post the update.

Technically yes. My guess is that it will impact the waiver. Lately as well, I have noticed a shift in people being told impaired is an issue.

The proof will be in your results though. I am particularly interested if it will impact the waiver because I had a recent client who I told to wait because they had a 2020 impaired on top of their old record.

Good Day All,
I've recently submitted my waiver applications (I-192 & I-212 July 7th) and I'm noticing a lot of responses from around this date. That's exciting and congrats to all that's been approved!
QUESTION: I do have a 2021 DUI conviction on my record and am wondering if that will affect my chances of being approved even though that particular offence doesn't require a waiver?

Congrats for your TN waiver.
I recently received my 2nd B1/B2 waiver and thinking of applying for TN waiver. Did you get the job offer first and then applied for the waiver? If yes, did the company wait for 3 months till you get the approval? Thanks in advance.

I should also mention that you are one of the few (if not only person in the recent past) persons who obtained a TN visa waiver among the people of this forum. I was quite concerned if waivers are given for TN/H1B etc. and am thankful that they are.

@admt Sure.

I needed a waiver because of an issue with a financial document(s) I submitted for my F1 visa back in my country of birth. I was using an overseas consultant who misled/misguided me in to doing it and I was subject to 212 (a) (6)(C) (i). It was a common practice in my home city I come from and so many people like me have got away doing the same thing and are now well settled in the US. I was unlucky to get caught and penalized for my mistake and went through the long route of eventually naturalizing as a Canadian (so that I could apply for TN visa and waiver at the border). Back in my home country, a lawyer I consulted told me that I have lost `half the world`(i.e. USA is half the world). By God's grace, I proved him wrong eventually.

One of the major reason I got a 5-year waiver is perhaps because my record is quite old (more than 10 years) and I have a TN petition approved for 3 years for a job offer from a reasonably big company.

I m pretty sure you will get a longer time waiver if you are able to get a TN petition approved. Try if any employer will do that for you and I would guess you will be set.

@skumar Nice, congrats! Do you mind me asking why you require a waiver? I got a one year waiver this year for a TN/B1 visa overstay. I'm looking to move back to the States under a TN but I figured since my waiver is only one year it's better to wait until a get at least a three year waiver .

Time for me to share the good news. I still cant believe it and it is still sinking into me.

I received 5-year waiver today at 10 AM ET to enter as a visitor and can apply for TN visa.

The application is created/paid and signed on 7th July, 2022 and I have been to PoE on 9th July, 2022 (although I received the email of submitted to ARO on the midnight MT of 10th of July).

So, it is 97 days since my biometrics at the border. So happy and relieved that I can't believe it yet.

Misuse of credit card data coupled with possession of property obtained by crime. 😵‍💫 old tho, convicted in 2007. No trouble since. @SFO

1 year waiver
Look at the weird timeline. File should have been closed but obviously the system wasn't activated that closes the files after 45 days.
2014 Possession of stolen Property - 9 months conditional sentence. Construction equipment.
