Handing in Waivers -Quarantine and timelines - Post here

J Rogersposted 2 years ago

Post real application stories here. Not "A guy told me" or "a few of my clients" but specific client experiences so others can see accurately what is happening.

There are rare exceptions, but whether you file a waiver, or a waiver AND an I-212 you simply get a waiver in return. That's why I tell clients to wait. Its an extra $930USD for the exact same waiver.

Sorry, that was meant for the response below

@Mistakes

Seems a lot of us are in the same boat. Best of luck. Fingers crossed for all of you.

@Mistakes
I’m on the same boat, I was arrested as a minor but got a conviction once I turned 18 ( but still convicted as minor) I need to attend several meeting in the US throughout the year.

So far they have not asked for more information I hope it’s a good sign

Good luck on your request

@J Rogers With the date getting closer, starting to get really nervous I was hoping to get some feedback.

Break and enter with intent. Arrest in 2014, conviction in 2019. I realize they do not care for the arrest date however I utilized it in my letter to show the growth over the last 9 years. Since arrest date I have started and completed a red Seal apprenticeship and been promoted into a instructor role. Letter from employer states the need for training in the states. Very specific location. Consistent.

Based on your history and the charge being 2019. What do you figure the chances are? The training is necessary for the job. Could I appeal if denied based on work?

6 month conditional sentence.

5 year waiver

8 convictions over a span of 14 years but last conviction was in 1986 - Possession.

@J Rogers
I thought because it was a possession 40 years ago that would count, I guess I was wrong.
So my drug charge when I was under 18 will block me as well, but I’ll be happy with 5 years waiver though.

Kev replied 1 year ago   #861

@J Rogers - your last post regarding Dec waiver has a wonky date. Can you confirm it was completed by ARO on April 10th? Thanks!

USofAwaiting replied 1 year ago   #860

@J Rogers Did you see any September Letters for misrepresentation10 years ago?

TomMa replied 1 year ago   #859

@Kev
I don't see any September Letters for drugs. Guns? Yes.

J Rogers replied 1 year ago   #858

@J Rogers
December 5th slowly getting there, thanks for the constant update. I’m about 2 weeks out.

Possession 40 years ago I would thought he would get a September letter but maybe depend on nature and quantity

Kev replied 1 year ago   #852

5 year waiver.
This poor lady was denied entry in 2016. No criminal record. They suspected her of something, but we are not sure what. She did finally admit to recreational drug use in the past when she was told she had to admit to something or else not be able to leave. They looked through her phone, found nothing.

A very puzzling waiver, I thought for sure they would give her a September Letter. She had wood samples with her (interior designer) so not sure what they were fishing for. Perhaps they thought she was visiting a client and trying to work illegally, but she doesn't seem to think so.

Waiver denied.
"6 aggravated felonies totaling 6 years in sentences".
He was last convicted of trafficking in 2013.
Notice the timeline. (went to the border in August)

17 conviction over a span of 10 years. Sentences ended in 2016.
I actually advised waiting to apply in April 2023, which would have been a full 10 years since the conviction. But he was hoping to get into the US before and willing to take a chance.

1 year waiver. This is his second 1 year waiver in a row.

This client has a sexually based offence. The "victim" was 16, so unusual that it would be granted. The mitigating circumstances is he maintained his innocence, the allegations were not egregious, and he had a letter of support from the victims father indicating that he believed the man was in fact not guilty.
This is obviously not "typical". He was also convicted in 1995.

The timeline is NOT typical of a re-application. The clients for "normal" waivers are November 29th-ish.
Notice the date "completed" for both was Good Friday. Very strange.
