Post real application stories here. Not "A guy told me" or "a few of my clients" but specific client experiences so others can see accurately what is happening.

There are rare exceptions, but whether you file a waiver, or a waiver AND an I-212 you simply get a waiver in return. That's why I tell clients to wait. Its an extra $930USD for the exact same waiver.

Appeals are tough, but I posted an example of a woman who won her appeal. They argued not enough time had elapsed, but the appeal judge said that Covid had caused a delay in her case, so therefore it was unfair to take the date of her conviction and not the date of the actual event.

This is an upsetting rejection.
Sexual assault, claims he didn't do it, and had a lot of evidence that he used at his trial. He also has letters of support from people who were there, current ones. They have designated him a tier III offender.
We applied under Obama and got him a 1 year. Then under Trump, they refused him (like all sexually based offences under Trump). I thought for sure they would give him one now, but not the case.

They have the BALLS to make this about "lack of targeted counselling" when very few people who claim they are innocent, then need counselling for an offence they didn't actually commit. Tier III offender? That is ridiculous.

Anyways, I think we will appeal.

Now that it is done through e-SAFE, the email is essentially useless. It was a tool that had it uses when you were worried that the waiver was lost in the mail.

Now? They know its not completed. They aren't checking your file when you email. I have a client who sends emails religiously every month since April 2022. No answer, same email every time.

The email is just a way for you to feel like your "doing something". I have a client, who I am pretty sure may never get an answer, he has been waiting 3 years. He did NOT use e-SAFE. He was friends with member of a bike gang. Every month, email. Every month, same response.

So in light of THOSE 2 examples, waiting even 200 days seems pretty minor. Just be patient.

When I applied for my waiver the email I got from ARO mentionned wait 120 days before requesting a status request, but after emailing them I received an auto reply mentioning they don’t answer if it’s less than 150 days.

Any idea on this?

5 year waiver, first application.
4 convictions, 11 year span, 2003 last one. One robbery in 1992, that's the most serious one.

2019 is considered very recent. You personal letter will be an important factor. Its not impossible, but not easy either.

I’m on the same boat, I was arrested as a minor but got a conviction once I turned 18 ( but still convicted as minor) I need to attend several meeting in the US throughout the year.

So far they have not asked for more information I hope it’s a good sign

@J Rogers With the date getting closer, starting to get really nervous I was hoping to get some feedback.

Break and enter with intent. Arrest in 2014, conviction in 2019. I realize they do not care for the arrest date however I utilized it in my letter to show the growth over the last 9 years. Since arrest date I have started and completed a red Seal apprenticeship and been promoted into a instructor role. Letter from employer states the need for training in the states. Very specific location. Consistent.

Based on your history and the charge being 2019. What do you figure the chances are? The training is necessary for the job. Could I appeal if denied based on work?

6 month conditional sentence.

I thought because it was a possession 40 years ago that would count, I guess I was wrong.
So my drug charge when I was under 18 will block me as well, but I’ll be happy with 5 years waiver though.
