TIMELINES FOR WAIVERS ONLY.

J Rogersposted 1 year ago

Because MANY people log on here to see timelines, not discussions, lets keep THIS thread ONLY for timelines. Then people don;t have to sift through to find out how long they are taking. I was trying to amend the old one but it got deleted, so I saved the last page, and added a bit to it. My apologies if you were looking for old info. The page was getting spammed all the time and had a lot of comments on it.

As for the timeline......when the fees went up the backlog slowed these applications down. That backlog is GONE. They could get every application they have done by Thanksgiving if they want. They do NOT want then done quickly. If this seems like "why would they do that?" then you aren't paying attention. Notice Canada has tariffs for made up reasons, and we have been threatened by Annexation. Notice Russia has not a SINGLE TARIFF. Notice Trump met with Putin in Alaska and got embarrassed. And STILL his "friends" have tariffs and the Russians.....nothing.

sorry everyone, my mistake, this is his FIRST waiver. Not a re-application.

Replies (recent first):

@cal123
I've done 2 waiver applications since retirement and have had no problem.
just state your previous employment history. (ie. retired after 20 years at XYZ company etc)

A question to RETIRED guys while applying.

Do we need to show financial stability or no need and just stick to the relevant point addressing the charge?

Wow! Timelines have really changed it seems. My last waiver took 13 Months(Dec '23 - Jan '25) for a 1 year renewal. I missed a number of trips because I didn't realize the timelines had gotten so long.

This time I did the application by myself for the first time. I assumed it would be another 9-13 month slog. But I just randomly checked my email tonight and there it was. Another 1 year renewal. This one took 4 months. I still have a couple months left on my other waiver but I guess it's better to have some overlap.

@J Rogers have you noticed that applications are moving faster now? I am seeing a lot posted from July '25?
Wondering if this is going to be the new norm or if its just a blip?

All the best to those waiting patiently...

September Letter

He had a 2 year waiver

inadmissible to the United States for having lived in the United States illegally from 2007 to 2014.

They gave him a 10 year ban. I guess now that his ban is up, they have decided to give him a September Letter. Living illegally in the US does not USUALLY result in a September Letter.

I actually got through the border multiple times and just that one time with the family, they stopped me. This was 2024.
My conviction goes back to 2014. For drugs.

So waiting about 10 years on my end but I think usually at 5 years it’s safe to try.

Yourstrulygenpop1 replied 3 months ago   #270

@Yourstrulygenpop What was your situation when you applied for your first one? meaning how long did you wait before applying?

The CHI replied 3 months ago   #269

Received my 3 year renewal today, Nov 2025. I started it in May 2025. So about 5 months total. First waiver was 1 year and took about 12 full months. My current one year doesn’t expire till April 2026, but didn’t know what to expect.

Good luck all! You got this!

1 year waiver

Client had a long youth record, but main offence is a sexual assault when he was 17 and victim was 16. (not a rape, coercion, but still SA)

He applied and at first 2 -6 month waivers. There were some charges, then dropped that were recent, which is why he was delayed. They also made him go to a panel doctor this time.

I am illustrating this to show that serious convictions CAN get a waiver, if its old and the circumstances are not heinous. Not to say ANY SA is not a terrible crime, but its a broad definition. Being drunk at a bar and touching a woman's outside of her clothes is as much a SA as any, but the ability to get a waiver is obviously different.

I once had a "potential client" who would get drunk, go to bars and was guilty of several (what can only be described as rapes) and I told him not to waste his time and money, he had no chance, despite being an old man (he was 71) He then went to a law firm, they billed him for $3000, and then made him gather EVERYTHING himself. He came to see me with his rejection letter, and I told him "why would I turn down money if I thought you had a chance?" The truth is people WANT to have hope. Law firms NEVER say no. But some waivers are not attainable.

2 waivers. The top one is a 4 year waiver. She had a Social Assistance Fraud in 2010. 9 months conditional sentence.

She has had 3 waivers. 1, 2, 4. I think they didn't give her a 5 year out of spite actually. (I have no evidence of this) I have only had a 4 year waiver once before, and it was a guy who had 4 years left on his ban. (Ironically they still made him do another waiver anyways)

The bottom guy is a re-application but he had a 5 and now another 5.

The bottom one was a woman with a serious trafficking in 2016, she applied again after being denied.

@mclitsonfairbaygmai

Yikes. Ok, the "RESPONSE" is what they send you when you REPLIED to them. If you DID NOT REPLY in 87 days, they AUTOMATICALLY deem your "non-response" as the response.

Did you respond? If not, then show me the timeline here that you have so far. Ill tell you what I think. The "response" doesn't have the letter, the letter was "request for more information"

You can call me at 905-459-9669 at the office if you want. John

J Rogers replied 3 months ago   #264

@mclitsonfairbaygmai when did you apply?
first waiver or second??

willbill replied 3 months ago   #263

@J Rogers

I have just received a "Request For More Information Response". When you received yours (date/time stamp 10/22/2025, 04:54 PM ) did they specify what they were asking for. I can not seem to locate anything with a specific ask.

mclitsonfairbaygmai replied 3 months ago   #262

5 year waiver

Longtime client, he has had multiple waivers

This time, they asked for court documents even though he has had a pardon, and we did provide the pardon and the same court documents we had always used, the ones from his pardon.

So he had to get a 1996 court document, and do privacy act fingerprints. he did, and they did give him another 5 year waiver. This guy is actually a Minister, and his reason for travelling now is to attend churches in the US, just to show they are willing to give ANYONE a hard time.
