Post real application stories here. Not "A guy told me" or "a few of my clients" but specific client experiences so others can see accurately what is happening.

There are rare exceptions, but whether you file a waiver, or a waiver AND an I-212 you simply get a waiver in return. That's why I tell clients to wait. Its an extra $930USD for the exact same waiver.

Yes you will have to do a secondary every 6 months. To prevent this happening with your family, go a day early to a land border and ask them to do it then. They will stamp your passport and then you probably will NOT get a secondary.

Do all Canadian criminal waiver holders require an I94? I was born in Canada. I am planning on crossing at the border and trying to understand how to avoid going to secondary. It will be my first time crossing with a waiver. I will be with my wife and kid, so any insight would be helpful. Its not clear whether I would require one or not.

I have never seen that message before (that I remember) probably because none of my clients send emails. ESAfe makes that a waste of time, since in the past it was possible that the waiver was mailed and lost in the mail, but now that's been rendered obsolete. (exception is if you do not use eSAFE then unfortunately emails are the only assurance you have)

@Ana no problem. I did actually see this posted somewhere else on a pro-Republican website, so I probably got a little hyper sensitive about it. I get your frustration, I am sure if I were in your shoes I would feel exactly the same.

In case no one noticed, I don't like Trump for various reasons, but any politician who makes it harder for my clients is one I am not going to like, Trump just happens to be one of the worst human beings alive, so that helps.

As for "why" the perceived slowdown, this is the reality of waivers. We will never TRULY know why, we can only speculate. What I do know is the Dems are PRO WAIVER, Pro Canadian, and every waiver client here is a Canadian Citizen.

I am having trouble with the border because of India right now. Sikhs who are politically active are being put on no fly lists, despite being Canadian Citizens, and now its clear they murdered a Canadian Citizen as well. The Current PM of India is not a good person, so imagine being an 18 year old Canadian Citizen, and you cannot cross the border because the Indian Government doesn't like your dad, who is not even in India anymore.

This is the whole election interference thing. Its not China, its India. Polievre and a member of his shadow cabinet are buddied with the very Government that murdered a Canadian Citizen.

@J Rogers we’ve gone from 5+ waivers being posted a day to less than 5 a week - over the last two months. I have trouble believing this is because of “cold and flu season” ??? Something is clearly up / wrong. I’ve never seen it this slow.

Thanks for your comments John. My apologies as my intention was not to spread conspiracy theories.
I am DEFINITELY not pro-Trump and did not intend for my comments to be taken as that. Simply that DHS resources may be stretched thin. Though who knows. The stress of the wait is making me speculate! :)

I appreciate your insights on the expected slow down and the ebbs and flows.

People like Trump get elected because of conspiracies like this. Its just volume plus the fact that its cold and flu season. Remember how many people applied to beat the deadline? I worked 4 days non stop during Easter weekend.

In North Carolina FEMA was trying to give people aid and 2 trucks full of "Militia" pulled up and literally tried to arrest the FEMA people. A man in North Carolina, and OLD MAN who has family in California wouldn't let himself get rescued by FEMA because online he read that the Government had made the storm so they could seize his home. His family could not get to him and he would not listen to them because they live in California. They were BEGGING for help.

41 million Americans are stupid. Not just stupid, but the kind of stupid Fanatics are made of. No different than 1933-1945 in Germany.

This election is literally going to be the the SOUL of this already troubled country. Forget the rapes, corruption, that he obviously works for Putin. Forget January 6th and trying a coup. This guy could ruin BOTH economies (Canada and the USA) and start a Civil war. He is so senile now that his speeches are deranged and make no sense. I follow this idiot closely and no one will be happy if he wins.

This delay is fully expected and when I look at my waivers, they are getting faster. The system ebbs and flows at it always has.

By the way, 9/11 waivers took so long truck drivers and some clients literally made FAKE waivers. That is why they do that check every 6 months. This is nothing compared to that. They basically took away all the permanent waivers and it took more than a year to get a new waiver. Jobs were lost. Lives ruined. It was terrible.

I have a feeling that approvals have slowed down due to the upcoming election. Resources are being pulled to process asylum seekers and other immigrants at the soithern border while Biden is still in office.
I sure hope I’m wrong :-/

They asked him for more documents in May, we responded with about 80% of them in June, but that's all the client could get. Mostly court documents. The client also did a new drug test as well, because he has a couple of trafficking's.

Before you sub,it a waiver, its important if you have more serious convictions to have as many court documents as you can gather. If they ask, you only get a small window (87 days) to get them what they want.

I will clarify why this guy got a September Letter. I cannot take all the credit because he has the right scenario to get one. I didn't MAKE this happen, I helped, but the situation was one where the elements were there.

First of all, notice the date, he went to the border 1 full year ago TODAY.

He has a Pardon.

-2007 ARMED ROBBERY (YOUTH COURT)
-2007 FAIL TO COMPLY WITH RECOGNIZANCE
-2008 FAIL TO COMPLY WITH RECOGNIZANCE
-2008 BREACH OF THE YOUTH CRIMINAL JUSTICE ACT

So serious conviction, but only 17 when he did this. All the others are adult convictions, stemming form this ONE conviction.

So technically, you could argue he was 17 when the "problem" happened, and the rest are just breaches as an adult arising from what he did as a kid.

So why they didn't mention you have to wait certain time before you apply for a waiver. Each case is different right. If the bar is over anyone can apply for the waiver and it will be approved. We need the expertise to get the waiver before the bar is over. In my case 2 years is decent for a 5 year Bar with the proper rehabilitation. Have you not seen people got approved less than one year of application? Different circumstances right? Please explain. Article is nor education etc category. Thanks

First of all, I understand your frustration. You want to go to the US, you filed the proper paperwork, and now some guy is telling you it won't work. Frustrating.

1. The US has no interest in who will get the waiver or won't. Their goal is to have you APPLY, so they get you on file, get your info, get your prints.
2. The officers at the border really know LITTLE about who gets it or who doesn't. Their job is to catch you, and tell you to apply for a waiver.
3. The US doesn't care about you. If not a single Canadian filed a waiver, they would be thrilled.
4. If you could get a waiver, or even in Canada, a Pardon RIGHT AFTER you did something wrong.....then why would ANYONE be truthful? Why have an application at all? Just let everyone in. Time is the biggest consideration in these applications.

All applications are different. I learn more from people who contact me after being rejected than I do from successful waivers because I also get a 4 page explanation. That is what I am basing my "opinion on" not just what you see posted here. Not a week goes by where someone emails me their rejection letter to ask my opinion. These are waivers I did NOT do.

I am NOT always right. I have been wrong in both directions. I have gotten a September Letter for a client who I told would be lucky to have 1 year. (aggravated assault) I have been "pretty sure":someone would get a yes and they got a no. Sometimes these "wrong" estimates change what i say, but sometimes I realize they are an outlier and I don;t change what I say to people.
