There are rare exceptions, but whether you file a waiver, or a waiver AND an I-212 you simply get a waiver in return. That's why I tell clients to wait. Its an extra $930USD for the exact same waiver.

2 year waiver - reapplication 1985 "unlawfully sell, furnish or give away marijuana" in Alabama (had a 1 year waiver)

@J Rogers - I wanted to follow up on the email and text message I sent you recently. I overstayed for two years in 2022 and received a ten-year ban as a consequence. In the past, I applied for a waiver with a lawyer's assistance, but my application was denied due to applying too early.
It has now been almost three years since the denial, and I am eager to proceed with the waiver application process. As suggested during our previous conversation in March 2023, I am reaching out to you now that the three-year waiting period is nearly complete.
I am interested in hiring your services to assist me in submitting my application for the second time. Could you please provide me with information on the steps required to retain your services?
Top guy has a serious record, was denied a waiver a few years ago, importing.
Bottom person impaired and possession of drugs 2014.
Both are getting a waiver granted for the first time.

To address the question of new policy, I have searched and cannot find anything online that officially signals a change in policy, but enough of my clients and people on here are saying the same thing....that they seem to be screening waivers every time, but even this seems to be inconclusive because sometimes they are not, which could be simply time/laziness/not aware of the policy. But its clear something has changed for sure.
In conclusion there is too much evidence to suggest these are isolated incidents, so everyone should at least be prepared for a secondary every time.
@Veryconcerned I was told in November by custom agent that this is new for EVRY person with Waiver. The issue is that you need to be at the airport 4 hours earlier JUST IN CASE. They don't care if there are 20 people in line in front of you and only ONE custom to agent to do 2nd inspection.
Wait so the new mandate / policy is secondary screening every single time Now??? @rogers isn’t that extremely concerning ?
Hello guys , I just left Toronto airport and went through secondary screening with my waiver . They do in-fact check every time you enter and verify your waiver
Instead of doing it every 6 months. They changed there policy.

Oof yes the waiver approvals have no consistent pattern. Pretty hilarious as to how each time we try to determine a pattern, they process a random one and throw us off LOL
You are using the wrong terminology. You HAVE to be charged to be on CPIC in any way. And a discharge IS a conviction. Dismissed, stayed, withdrawn charges are NOT convictions. To get a conditional or absolute discharge you must be charged, then plead guilty. The METHOD OF REMOVAL is the only difference between a discharge and a regular conviction. Both appear the same on CPIC.
This client had a serious record, but it was old.
