Yes John does give really good advice, he told me like he will probably tell you, not to appeal it (i had this option too) when you appeal it, it still goes through ARO first , and ur chances of winning an appeal is very unlikely, unless they made some kind of mistake which i dont beleive they think they did seeing how you admitted (just like me) to the act. I would listen to John and just let it be, don’t apply again until next year.

I spoke with John his helpful and told me to wait until May 2019 to send end the papers . Should I first send the the appeal papers since I only have 30 days and then decide to reapply ? What happens now

Hi I applied 4 months after I was denied entry to the states . It’s telling me that I have 30 days and have to pay 110$ to send to admissibility review office .

@Sarah22 im in the same situation as you I actually got turned away for the same exact thing & i also got turned back in the same month/ year as you. I also got a letter of denial but in Dec 2017, I basically applied 2months after they denied me in may of 2016 (applied 2016). As much as it sucks i am not applying again until 2019, at this point it will be 3 years since i got turned away. Im not sure what it stated on your letter as to why they denied you but mine did not specify , it only said at this time we are not using our descretion. Ive heard from people on this forum that waiting 5 years after is the best thing to do , but I will take my chances at 3yrs and if that doesnt work i will try again at the 5 yr mark.

#1233 There are a few things with your case. It is written in the immigration code that you can be deemed to have criminality just by admitting to essentially committing the crime. It does not necessarily need to be a conviction. They don't need proof since a person's word is proof enough under the code. A lot of people don't understand how the code is written.

An example is let us say that you crossed the border and the guard asked you if you have ever done anything illegal that you have not been caught for. You then volunteer that you held up the Bank of Nova Scotia at gunpoint in 2002 but were never caught. You would then need to file for a waiver for admitting to the crime of Bank Robbery.

Plus you should not apply unless you account for/overcome the specific reason for denial first. If not, then you will likely get another denial since the service will say that nothing has changed. I suspect that one reason they listed was that there was no evidence of rehabilitation/reformation of character?

Did they give you reasons for denial? Was probably too soon after being barred...

Hi I was denied entry on May 2016 for section 212 prostitution there was no proof except I said that i did it because the security told me I’d get on the last flight .
Today After 2 year of waiting I got my reply I was denied entry .
I’m happy that at least I got a answer .
Now my question is when should I reply for a waiver ? Should I wait ? Is it the same procedure ?

Trafficking convictions are now getting major scrutiny and are extremely difficult to clear under Trump. Yes, it is true that they take an extremely long time to get adjudicated by CBP. We have developed a technique that we think will get a trafficking case cleared. We have also done the same on a molestation case.

We are currently using it on 2 clients as a test. One client lives in England and we are running his case through our London office and through the US embassy in London. Currently, we are doing our due diligence and getting all the info from the databases to put his together. It will be tough since he was caught with 30 bricks of Cocaine in Washington State some time ago. We are especially interested in his case since England is full of people with ex-criminality and will be a great market for us.

We are doing both of their cases for free since we do not know if it will work and I do not want to charge someone knowing that it would get denied. If successful, then we can use it in other trafficking cases. It will not be a cheap process though and will cost between$3500-$6500.

We will keep everyone updated and I think with this offence we may even go as far as doing a money back guarantee on it if we can perfect it.

Trafficking offences as I posted in another thread seem to be getting increased scrutiny and I am seeing a higher number of rejections recently. Bear in mind that the recent rejections were not handed in 90 days ago, but in many cases a year ago.

My charge was upgraded to trafficking, I did put in a clean drug test, also I gave them really good infor how I have changed my life around

Ok well if you were in BC, then those cases tend to average around the 4-6 mark for us to get an approval. They tend to not be as hard on drug possession as opposed to the trafficking..Hopefully, you put in enough good info and rehabilitation and a clean drug test. They asked us for a drug test on a client that had a 1995 conviction for possession of a roach in Washington State.

I have not seen your packet but I will assume that you will not have any issues. However, please let us know if they write back and give you an RFE(Request for Evidence) and 87 days to respond
