Valid USWaiver

I have a valid waiver till Sept 30 2024, we are snowbirds and I just re applied, ESafe, when I went to do biometrics the CBP officer told me to head to Florida while my waiver is still valid. So if I leave last September, we I be alright as the waiver is still valid?

Has anyone gotten an approval that has applied since February. I applied February 23 and my trip is coming up in September. I am getting antsy!

I would ONLY advise anyone to do this IF you can the CARD, name and BADGE # of the person who said it is ok. Remember, if they "catch" you, and they WILL see that you did this, you have BREACHED the agreement you made with Homeland Security. So you go, you stay, you come back to Canada. Your new waiver comes. The FIRST TIME you use that waiver, they will 100% do a SECONDARY where they check your entry and exits. You will have a DIFFERENT guy than the guy who "said its ok". If he decides you "did something wrong" you are NOT travelling THAT day, your new waiver is VOIDED and you will not be entering the US for 3-5 years after that. NOT worth it.

But I am 100% confident that most people will believe an American in a uniform over a Canadians who is an expert. Right? Like the exchange rate, I must be 30% less intelligent than a guy stationed at the Canadian American border. LOL.

So technically, this is NOT correct. You are not allowed to enter on the last day of your waiver and then stay. Think about it. I have a 5 year waiver. On the last day I go to the US and stay for 6 months. So its a 5.5 year waiver now? What about 1 year waivers? Then its a 18 month waiver?

So I have NO doubt the guy told you that, but if they realize you stayed without a valid waiver, what are you going to tell them? "oh this guy I will never see again, who I don't have a name or badge number said its ok?"

If you are being TOLD you can do this, then get the guys name and badge number, I GUARANTEE if you are caught doing this 80% of officers will see this as a breach. They keep records now of entry and exit.

I have had client told this, and there are times where it turned out ok. But the waiver is NOT for just entry. Its a 5 year waiver, which means you can be PRESENT in the US for THAT 5 year period. I have clients who are (rarely) given a 6 month waiver. Do you really think they do that knowing you can stay for an extra 6 months? Most of those people are sex offenders....so no.

Thank you….. he also said when I get the new waiver and still in the USA, go home for a couple days then return .

Yes. The waiver is simply for entry. As long as it is valid on entry you can stay past the expiry date.
