Upcoming waiver expiry- when to start process?

Timposted 3 years ago

My most recent 5 year waiver is expiring in May of 2021. I would like to renew, and am wondering if I should start the process now? I assume I can submit my application to DHS prior to the other waiver expiring, and that won't be an issue?

Also, to clarify- I was recently granted a pardon/record suspension from the Canadian Parole Board. Now, my record checks return clean. I take this make no difference to DHS, as I will still require a Travel Waiver to enter the US, due to past criminal convictions?

We are going to do a live stream YouTube & Internet talk radio show episode tomorrow at 12 noon in Surrey B.C. People can call in if they want any questions answered about US Entry Waivers. Other waiver providers also have the opportunity to call in to our show. We will touch upon Tim's question at this time as well. We will also mention some of the techniques that we use to prepare complex US Entry Waiver cases and September Letters.

We are still the only Canadian business in this waiver/border crossing industry that does September Letters, complex US Entry Waiver cases, has locations in B.C., England and Washington State, has a call in internet talk radio show combined with YouTube, and a 98-99% success rate. Tomorrow will be a casual day and I will be dressed in such a casual fashion.

We will not be able to spend as much time here on the forum since the Biden election has changed this for us in a great way. I have also enrolled into higher education, and this means my schedule will be even tighter in the near future.

@Tim you SHOULD show the pardon, or a second set of fingerprints obtained through the privacy act. (Michelle does this for all waiver clients I believe)

If you just show a blank record, Homeland Security is going to simply ask you for more documents. If you need a copy of your pardon, we can help you obtain a free copy. Also, a second set of fingerprints can show the record as I mentioned.

The reason has nothing to do with rehabilitation, and everything to do with showing Homeland Security EVERYTHING they need to make a decision quickly.

@tim Just to recap that now is indeed the time to start since it is already November. I don't want the message to get missed due to a distraction from another individual worrying about why the particular border called us on a different matter. The question is too complex for him to answer due to the simplicity of the request. Also, note that including your pardon is a good idea but it is not necessarily a requirement if you cannot find a copy. The border does not recognize a Canadian pardon anyway but it does show more rehabilitation if you have a copy. Just thought I would recap since I just got asked this question by one of our clients just now.

I have just seen this post since we have had a major uptick in casework since Biden won. Anyway, J.R. I do not have time to soothe your frail 2-inch ego. I do not care if you do not believe me whether the Eastern border called or not. I have the supervisor's name and telephone number. Anyway, the point is that we are really getting into great things now to include expanding our internet talk radio show and youtube. Here is an interview for all to see that I did Sunday at the Surrey office with a client that has a border issue.

J.R. we do not have time to sit around and discuss online politics since this is what my grandparents do. You are obviously free to do as you wish.

Also Btw J.R. I said Eastern border because it is none of your business which one called us. I purposely keep some things vague since I offer you zero benefit of knowing anything in general. You have no clue about the new things that we are currently doing since it is always posted on our business FB page and other locations. I post stuff here as a courtesy to the members here only. Your opinion is highly irrelevant.

@KenScott

Why would an "Eastern Border" call you? Makes no sense. And if this was actually true, you wouldn't say "eastern border" to keep it vague. No one called you. There is no need to make stuff up during a time when people are searching REAL answers.

Hey I know we are Homeland Security with actual bosses in Virginia, but lets get some answers in.... British Columbia. Its only 3000 miles away. And lets not call ANY other borders either. Why would any other ports, manned by Americans, know anything? As a matter a fact, lets call Ken Scott with his New York prefix cell phone and english accent. We always reach out to people in Canada, who don;t even live there half the time for answers to our border issues. I am sure HE can give us answers. I mean, he is probably standing by his mailbox right now.

@Tim remember you need to show a COPY of your pardon with your application. SInce the fingerprints are valid for 15 months, I agree with Michelle. Nothing wrong with starting now.

I have to agree with Michelle and add in a small twist. I received a call from an Eastern border asking us about fingerprints and wanted to know if we had any clarification on this issue regarding the new policy. I was surprised and they said that we were the 5th place that they had called since no other places answered. I posted this on our facebook the other day but did not post it here. Days before, I had called our BC borders and one officer had to put me on hold to ask the supervisor. The officer returned and said yes to the policy on allowing the truck drivers down.

Anyway, it seems that some ports are possibly unaware of the new policy allowing truck drivers to come down and apply. I informed them of what we had regarding the info on this new policy. I also gave this border the phone number of the particular BC border(s) that we deal with to confirm the details. So yeah just note that your border may or may not be aware of the new policy.

@Tim, you might as well start the process, it takes awhile to gather all the necessary paperwork, and at least you will have it for when the border starts accepting again. It will not be an issue to re-apply for your renewal waiver before the other one expires. If you are an essential worker such as a truck driver, you can deliver your application now, however; no-one else is allowed at this time. Usually, a Pardon makes no difference to the USA, and once you receive a waiver, you must keep doing renewals, until the USA tells you different.
