Submitting Waiver application without Evidence of No Pardon record

srcanposted 2 years ago

Hello Everyone,

First time waiver application here. I'm working with a lawyer on my waiver application. But I'm doing most of the work myself.

I recently submitted a request with Parole Board of Canada to get Evidence of No Pardon record. I was told today that it would take around 30 days to get the document. I've all other documents ready to submit the waiver application. So my lawyer suggested to apply without the document to save time and upload it later when they request it during processing.

Do anyone see any problem with submitting the waiver application without Evidence of No Pardon record?

My inadmissibility is because of misrepresentation in a visa application that I did in 2011.

Thank you in advance.

@srcan "working with a Lawyer". Almost always a red flag. Why would you play a lawyer ANYTHING and do most of the work? Lawyers are great for certain things. If you are defending yourself in court, or suing someone, get a lawyer. Waivers? You can hire a person who specializes in waivers, usually for far less than you pay a lawyer. Many of us are accredited by the RCMP as well. This is what I do, all day EVERY day.

Worse, I assume the lawyer is the one who used that ridiculous terminology.

Evidence of No Pardon record

You can send to the Parole Board to get a copy of your PARDONED RECORD which is sealed. There is absolutely NOTHING else you could get from them, and there is a faster way.

If you have a record that has NOT BEEN PARDONED, the parole board isn't the place to go, its the RCMP, and if they do not have it, the local police who arrested you.

If you have a pardon, you can get a copy of everything through the privacy act as well. The same place that does fingerprints can do this, its cheaper than the regular RCMP prints and if you have a pardon, it shows the record, and shows its been pardoned.
