Staying more than 6 months?

JohnB2posted 1 year ago

I understand that the U.S. CBP has the discretion to approve someone coming into the U.S. from Canada and staying longer than six months? I believe that is true.

My question is, let's say CBP approves someone to stay for 1 year. When they leave the U.S. do they have to then be gone for 1 year or can they stay away for 6 months and then be able to reenter? Anyone know? @J rogers?

I really don't know 100%. There are consequences for the person leaving Canada for more than 6 months, for example, healthcare coverage etc.

I would be VERY careful, because you don't want ANY obstacles to the person ultimately getting a green card.
