Sexually Based Offences or trying an application when you might fail

Trumps Homeland Security is NOT issuing waivers for sexually based offences.

Should you try anyways? No.

When you do an application, you are outlining a bunch of facts that can be used against you in the future. If you don't care about the money, then care about this...whatever you said/say WILL be used against you in the future.

If you have a serious offence, and especially a sexually based offence of any type (many of these have nothing to do with raping a woman, they can be voyeurism, they can be unwanted touching in a club, they can be "being caught in a swingers club" they can be two men having consensual sex. They can be an 18 year old having sex with a 15 year old, literally a grade 12 and grade 10 having sex. If you have an offence that mentions anything sexual please listen to the following.

1. Do not do the waiver on your own
2. Do not write your own personal letter
3. Do not let your friends write their own reference letters.
4. Do not apply NOW. Wait until 2021.
5. Start collecting "proof of rehabilitation" now. That varies from case to case but I can help you with that
6. Do not apply for the waiver anyways because you don't care about the money. Your screwing up your FUTURE waivers by handing in a shitty waiver now.

A cookie cutter waiver works for simple waivers. Sexually based offences of ANY kind are not simple.

Now that you have proven your point, you can now disappear, since you only APPEARED apparently to prove that is can be done. Cue flood of applicants with sexually based offences.

@Ambassador, I noticed you advise "unrestricted" travel? Does your waiver state the special Order? The few clients that I have who have received waivers for sex offense have the the Order listed: (I won't list it on here) at the bottom of the their waiver, and they are do have trouble crossing the odd time..If you haven't had any trouble, just keep in mind that you might depending on the Custom Officer you may deal with..

@ambassdor, Did you see Dr. Chema, as he is the only approved Dr in BC? How long did you wait to see him? He is so difficult to get into? He keeps advising my client's that they need to see a Physiologist here in Saskatchewan first, then he will review their assessment, and then provide an appointment..This is extremely difficult, as the waiting list here to see a Physiologist for anything Sexual is 1 to 2 year waiting list, without a court ordered exam. So frustrating.....

I also want to add that not all immigration lawyers are bad. Preparing these cases can be a lot of work and yes professionals would like to be adequately compensated. The lawyers that we work with are very reasonable.

An example is that we have a woman that got a 5 year ban but qualifies for Derivivative U.S. Citizenship through her dad. We referred her to one of our lawyers to get her US passport. It can be a long process documentating this kind of case. If she gets her USA passport then she does not need a waiver since she will be an American. If she does not qualify, then we will do her waiver and it will be only a 1 time thing in her case.

Please note that this process can apply to a person that has an actual conviction for Rape or Sexual Assault if they qualify for Derivivative Citizenship. This is because CBP cannot deny entry to A U.S. Citizen that has any kind of conviction whatsover anywhere in the world.

My 2 cents.

Please note that my colleague is mistaken regarding that we no longer do waivers since we are clearing people with waivers monthy at our BC and overseas locations(www.usentrywaiverservices.com).

Anyway, they are still approving waivers(at least for us) for sex related crimes but I will agree that they are a lof of major work now under Trump. Also note that the individual in the particular talk radio show episode is reformed/rehabilitated and indeed a real person that had a past. He now works for me and runs one of my BC locations. I also do not know Ambassador.

The bottom line is that yes you can still get waivers for sex related crimes but it is a major battle. We can do it but it definitely is not a cheap price and again it is major work. We get a very large number of former BC traffickers that use us and even their cases have again changed under Trump here very recently.

Also note that I am not here that often because it is a lot of work for us to keep cases flowing in a timely manner. Hence I do not have the time to come here as much but we are definitely still in business as our Facebook friends and FB business fan page friends are well aware.

Went on the Millar and Hayes site and its hard to conceive that the firm mentioned in the reviews were the same "geniuses" that were able to overcome your sexually based offence. I called them as well and they seem like pretty typical immigration lawyers. Very vague and charge pretty high fees.

As for your two posts, they contradict.

"I was denied the first time, appealed, and the BIA overturned the decision and I'm now allowed unrestricted travel across the border" (post 1)

Appeals rarely work. But if "the BIA acknowledged that ARO misrepresented some of the details" I would love to see that.

Listen, this is an inexact science. People will eventually be able to get waivers issued for sexually based offences again. But your post, transparently false, gives people the wrong idea. Worse, your going to get people to apply at some random firm you looked up, and they are going to waste a LOT of money on a firm that doesn't even specialize in waivers. All because you want to prove some guy on a waiver forum wrong.

We know who you are, your the guy who poses as the "ex gang member" on On Ken's podcasts. Or you did before Ken stopped doing waivers. If you have REAL information to post, please bring it forward. A lot of people on here are anxious for REAL hope and real information.

Sorry everyone, I did not disappear. I was away on vacation. Just arrived home tonight. I assure you I'm not full of sh*t. I went thru multiple applications. My apologies Mr. Rogers, I didn't mean to call you out with gusto. I was really just heated, excited and slightly drunk over the celebration of my first crossing right around the time you advised people not to apply with a sexual offence.

I'm not going to be giving any details of my particular case over the Internet, anonymous or not. I don't really mind if you want to chastise me as a liar. I'm only trying to give people who might be in my situation some hope that it is in fact possible, even with the current administration. If you don't want to believe my word, fine, I'm not taking that personally.

What I will say, is I had a lot of positive equities going for me. Time passed, stable and professional career, and my own personal letter as well as reference letters from my my friends, which was all mentioned in my waiver by the BIA as having a positive impact. I did do a psych assessment which naturally turned out favorable for me.

The big problem I had in this process was the ARO misrepresenting details of my case. But I had the best representation for me at Millar and Hayes in Vancouver. Andrew Hayes was with me from the beginning and worked feverishly to fight for me. I genuinely believed he wanted so bad for me to succeed. He genuinely cared. After my second denial he said he'd understood if I went another direction. I said no way. I trusted him with my life and he came thru. And the joy in his face when I saw him after I received my waiver was palpable. So please if you're in my position, and you're in the BC area, I highly recommend you go talk to them.

His firm also has an office in Washington which proves beneficial having an American root.

Hope this helps. I think I could have done a better job with the body of this message but I'm exhausted. I've been on airplanes for the last 22 hours and I'm jet lagged as heck.

@Ambassador, You are extremely lucky to have received a waiver, after denial, and especially after an appeal..Please provide the name of your lawyer for reference for the others on here and which Panel Doctor you went to, as Dr. Cheema, is not giving appointments without a previous Physiologic assessment.

@Ambassador well if what you are saying is true, then give us some general details, plus the crux of the argument that overturned the decision. Also the "attorney" who was so wonderful....name and phone number. Lets give this person the accolades they deserve.

Oh let me guess.....your going to disappear now. Because I think this post is actually not true. But I am willing to be convinced and give people hope.

Funny how you have "suddenly appeared".

If your really legit, then send the decision with the BIA to Michelle by email. I trust her and she can be trusted to be confidential. She can (without giving too much detail) confirm your story. Then we can send people who are getting denied to your "attorney".

I'm sorry but I disagree COMPLETELY. Why? Unlike the poster, I have an offence that Mr. Rogers mentions. Ya, it's embarrassing and I regret it fully. I had to listen to people like Rogers tell me crossing the border would be VERY UNLIKELY, if not IMPOSSIBLE. Guess what? I was just granted a waiver. And the letter I received was very favourable towards me with the BIA ORDERING the waiver be issued. Something that is RARE. Everyone's situation is different. I was denied the first time, appealed, and the BIA overturned the decision and I'm now allowed unrestricted travel across the border.

Listen folks, not all of you will get the same results. Really depends on your merit and positive equities, time passed etc. My attorney was nothing short of sensational in this whole process. Even with Trump's admin. Just did my first border crossing in decades. The border guard when I handed my waiver? Well SHE was lovely. And made me feel good about my first crossing.

ITS NOT THE END OF THE WORLD!!!! Not for all of you. There is hope, unlike what Rogers says.

I completely agree with John..Sexual based waivers are extremely difficult to obtain. No matter how minor the offense is. I normally do not even attempt them, however, I have just accepted a voyeurism file..only because client begged and pleaded...I am not confident of the outcome...but have been 100% honest with them..so will keep everyone posted..
