September Letter

Hey John Rogers! I believe you have a lot of experience when it comes to this so I wanted to point you a question to you. What are the qualifications or prerequisites to get a September letter? Could potentially anyone get approved for this over a long period of time with regular approvals?

@Ana There is a lot of conflicting information out there.

Technically the ban isn't really that meaningful. I have gotten waivers when bans were still in effect. The myth is that if you "serve" your ban you do not need a waiver after. Maybe in exceptional circumstances (I have seen it but its rare) but almost every client who has a ban of ANY length continues with waivers when the ban is finished.

Its confusing and in many cases, doesn't follow hard and fast rules.

@J Rogers - my understanding is that those that overstayed have a 10 year ban and subsequently can travel waiver-free. Do they require a September letter as well?

@J Rogers It is the same procedure as getting a waiver, just the resulting letter is worded to let you know you do not need a waiver.

Homeland Security is deciding that the person is no longer or is not in need of a waiver. Some gun charges are easy September Letters. Its not something you "apply for" it CAN happen under certain circumstances when you apply for a waiver if you provide the proper information.
