Possible waiver for fraud over

Hi everyone, I would like honest opinion about the possibility of obtaining a waiver for fraud over which occurred over 8 years ago. Mi consulted with a gentleman who does waiver and has lots of positive reviews however he said because I have restitution that has not been paid in full, I should not waste my money. Any advice or suggestions would be great. I mean he was genuine but I’m looking for second opinion. He suggested I start paying the restitution through the courts because I’m not allowed to contact the individual. Many thanks

@jazzsax1 ok. I look at it this way, we have to take responsibility for our actions so come what may. However, so far, there is nothing negative on my credit report.

It only affects their credit it the personal holding the restitution order converts it to a civil judgement. It would then show on your credit bureau. If you pull your credit bureau you will know if it’s there if it shows under “public record”

@jazzsax1 thanks for your response. What are your concerns about applying for the waiver? Yes I called the courts and the lady said they issue only letters for waiver because my file is 8 years old so they have to “dig” it up. I don’t even know what that means. Yes I’ll start paying again since she said that people have told her it affected their credit.

The courts do track it but depending on your case you may have extra liberties. For me, it was a large restitution amount on a stand alone order, but there was a note “no time limit to pay” and the order can’t be turned into a civil judgement as the victim worked with me as part of a debt proposal to resort my finances so I could pay him better over time.

You definitely should be making an effort and keeping copies of all of your payments as the court house i deal with often has the payments sitting on a desk for months without processing them. They also only send proof of payment if you ask for it.

I was lucky as well though in that mine does not show up on CPIC either. I haven’t applied for a waiver yet though. (I’m at about 7 years post conviction)

@J Rogers yes the last police check I did I had to submit prints and it said “restitution $40000”. I have never asked for or seen court documents so I don’t know what that would look like. Thanks again for your response and advice

Doe the RCMP record specifically SAY you have restitution and the amount? My suggestion is to get your fingerprints done now. When they come in, tell me what they say. Then don't forget, the court documents may possibly say that they aren't tracking payment. So start there.

@J Rogers ok would it be more ideal if I figure out a way to start making payments again before I think about submitting an application? I was hoping to go visit family for March break.

Restitution CAN be an issue. It also depends on the size. I have submitted waivers where the client confirmed they were making payments or had a good reason it was still not paid, and that can be successful sometimes. Ideally it is paid obviously.

@Sophia restitution meaning paying money back to the to the victim. Thank you for your response. Did you work with an agency or do it yourself waiver application?

hey hun not sure if it will help you but i was charged with fraud over years ago and they changed it to theft over however i was convicted ... since i had two waivers first was onlynfor 6 months and second for 5 years. if you dont mind me asking what you mean by restitution? @Tiffany
