The election of Donald Trump in 2024 will dramatically reshaped US immigration policies again, and his return to the White House could continue to have a profound impact on individuals applying for US entry waivers. If you're facing issues entering the United States due to a criminal record or immigration violation, understanding how political shifts—especially with Trump’s influence—could affect your US entry waiver case is crucial.
The Changing Landscape of US Immigration Under Trump
When Donald Trump was president from 2017 to 2021, his administration enacted policies that were less favourable to individuals with criminal records, particularly regarding border security and immigration. His “America First” stance focused heavily on reducing illegal immigration, which led to stricter enforcement measures for entry into the United States.
Some of the most significant policies that impacted US entry waivers included:
1. Stricter Vetting Processes: During Trump’s tenure, there was an increase in the vetting process for anyone applying for entry into the United States, especially individuals with a criminal history or immigration violations. This made it more challenging for applicants to secure a waiver, as the US government prioritized national security.
2. Increased Border Enforcement: Trump’s policies sought to tighten border security, resulting in more scrutiny of individuals attempting to cross into the US. This included enhanced surveillance, more questioning, and rigorous checks at the border for anyone with prior offenses, even if those offenses were not recent.
3. Criminal Record Scrutiny: Individuals applying for a US entry waiver under Trump’s administration saw heightened scrutiny of their criminal records. The process was more stringent, and the chances of denial were higher, especially for those with convictions related to drugs, theft, or immigration-related offenses.
4. Changes to Waiver Approval Guidelines: Under Trump, the process for approving waivers became more rigid, and individuals with certain criminal convictions, especially felonies, faced increased difficulties obtaining approval for entry.
With a second term for Trump, many of his previous policies will likely be reinstated, or even expanded upon. Here are a few likely scenarios that could impact your US entry waiver case:
• Tougher Entry Requirements: Trump's focus on protecting US borders could result in even stricter vetting processes. If you have a criminal record, this could mean more scrutiny and a longer wait time for your waiver application to be processed.
• Focus on National Security: As seen during Trump’s first presidency, national security concerns were a priority, leading to increased difficulty for applicants with certain criminal records to be approved for entry. This could be particularly challenging if your offense was deemed a risk to US safety.
• Potential Changes to Waiver Eligibility: Trump’s administration may choose to make changes to the US entry waiver eligibility requirements, which could exclude individuals with specific criminal offenses from receiving approval.
What Can You Do to Protect Your US Entry Waiver Case?
Understand Your Eligibility: Approval of a US entry waiver is not guaranteed, especially under stricter enforcement policies. It’s important to understand your eligibility and whether you need the waiver, as some individuals may not need one depending on the specifics of their case.

We cannot know until we see what actually changes. Trump himself cares little about Canada in reality. Therefore it probably would be his appointee who might change things.
The last time he was in power, sexually based offences were turned down regardless of circumstances and they gave out few September Letters. Under Biden, I got a September Letter at least once a month.
Lets wait and see and not panic. Things might change.
