Fee increase

I was looking at the this website this morning and see that an update was done on june 29..advising I 192 filing fee is now $930..I have not received any official notice..but not surprised..John..have u heard anything?

Mangus and all, my apologies, I never think about the USCIS offices for filing an I-192, as Calgary or Vancouver offices, absolutely refuse any applications, and in fact, will not even set up an appointment for the I-192. They advise that this paperwork is to be delivered only to a USA Port of Entry. I have sent several people there, (when I did get an appointment) and all paperwork was rejected. So, I only consider the POE, so very happy to see that the price is the same for delivery there. Thanks again..

Instead, you must apply for a nonimmigrant visa at a U.S. Embassy or Consulate for authorization to travel. You should contact the appropriate U.S. Embassy or Consulate if you have any questions regarding your admissibility under the VWP."

The Visa Waiver Program is a list of about 26 countries or so where the people get to visit the USA for up to 90 days under the category of business or pleasure and do not actually have to file for a B-1/B-2 visa at the embassy/consulate. However, some people do not qualify and have to get the B-1/B-2 visa.

You are 100% correct Magnus since yes it is a new form and there has really not been a fee change. I will say in defence of Michelle is that about a year ago I saw the $930 amount and initially also thought for a second that it had been raised for everyone. However, I decided to dig further the same day and saw the breakdown on page 8 since it did not seem logical to me initially.

Also, I tell my waiver clients to stay away from the border until they start accepting packets again. Although we prepared a TN visa for a guy in May and sent him to the border to file since CBP will still accept these petitions. It seems that they have recently switched over under the USMCA agreement and we need to now study the changes.

The $930 govt fee is for waivers filed under the the T and U visa categories. These waivers are for victims of crime and human trafficking that have cooperated with law enforcement and/or suffered mental abuse. I have honestly never worked solo on either one but I remembering engaging with a lawyer in her office that was working on a T Visa for some female sex trafficking victims. I looked over her petition and helped her with the law enforcement portion of her presentation in the packet. Never worked on a U visa though.

From page 8 of the form:


The filing fee for Form I-192 depends on the agency that makes the decision on your application.
1. If filing with USCIS, the filing fee for Form I-192 is $930.
2. If filing with CBP, the filing fee for Form I-192 is $585.
A fee waiver request will be considered in accordance with 8 CFR 103.7(c) for the following individuals:
1. An applicant for T nonimmigrant status; and
2. A petitioner for U nonimmigrant status.
NOTE: The filing fee is not refundable, regardless of any...

So what changed?

If you read closely there’s nothing in here that states filing a waiver (as many did before) that a fee increase for the filing of that waiver happened.

One can glean that the filing fee of $585 is still the same and that this is for something else and hence the $930 is for some other form and not just a standard waiver.

Am I correct?

Well yeah of course John CBP will not take waiver packets since it has been this way since about March 21st or so. I thought that you would be aware of this situation Also, the fee structure is broken down on page 8 in the instructions for the waiver application in the link. It clearly shows that the 930fee is for a waiver processed through USCIS as opposed to the CBP waiver fee of $585. https://www.uscis.gov/i-192

@J Rogers the form in the link is a completely different form from what was required for a waiver before. That’s how I read it.

When I am back in the office I will take a deeper look at this. But on the surface it looks like they have increased the fee to $930, which is still way better than $1400.

To date I have had a couple of clients go to Niagara Falls and they would not take the waiver. (No other consequence, they just said no, they went back to Canada)

Hey, do you have the link for this listing? There can be some confusion about the fee but it is cleared up and broken down in the waiver instruction sheet. However, this may not account for the June 29 date that you mentioned.
