Just came across this newsarticle where a flight from Toronto to Vancouver was diverted to Seattle due to weather and mechanical.
Now this made me think, what would happen to someone who is inadmissible to USA and has no waiver and now lands unplanned in USA.
Did that ever happen to someone?
As my spouse is not eligible for a waiver another 5 years due to a criminal record in the USA (drugs) and we usually travel within Canada and to Europe and Asia.
In a scenario like this, your spouse will be denied entry and kept in quarantine. They will likely be monitored and told not to leave the premises. CBP agents will schedule a flight to get that person out of the country as soon as possible at the inadmissible person's expense. Refusal to cooperate with authorities will likely end with unnecessary detention times and charges.
Most likely scenario is that they keep you sequestered in a specific area (secondary perhaps) in the airport and you wouldn't face any kind of charges since it would have been an event that you hadn't orchestrated yourself.
That would be the most foreseeable thing. It's America so you never know. Maybe they take you to the southern border and lock you in a cage. ;)
