Waiver Files being "closed" by Homeland Security. Mistake? Or deliberate?

This has happened to 4 of my clients since May 2021.

Homeland Security asks for additional information. They give the client 87 days. We submit the information. Months later, they ignore that fact it CLEARLY says on the "Status" that they received the response. They close the file. Worse, the decision is final unless you pay $675USD.

In all 4 cases, I advised the client to re-file. I don't charge them, we still have everything, (fingerprints are still good) and on top of that, we can amen d the personal letter, to whine about the file being closed erroneously and we can give them the additional information up front.

I have 2 of them on the go, no answer yet. The files all were difficult ones. All the people were expecting they "might" be rejected, but all applied with the understanding that if they were rejected, we would at least have 4 pages of details as to why Homeland Security said "no". Now they have robbed us of that feedback as well.

If this happened to simpler files, I would assume a glitch. But ONLY to difficult files where a rejection would actually AID us in responding and getting a better opportunity to re-apply? That seems DELIBERATE.

Here is the "history". You can clearly see we responded before 87 days. In all 4 cases, we responded with EXACTLY what they asked for as well.

Or just one clerk who doesn't want to do the hard work involved in the rejection letters. Be interesting to see if they were all closed by the same person.

CBP and it’s auxiliary offices are all subject to the widespread labour shortage everyone is experiencing. I’m curious if the review office is making errors/mistakes like this due to being overwhelmed.
