unrelated to waivers but can anyone ...

Hello this is unrelated to US waiver but has anyone without a pardon tried applying for the ETIA for transit purpose to Europe? What was the outcome and was the approval immediate or they had to summit more paperwork. I'll really appreciate an answer to this if anyone knows someone or has tried applying themselves. Thanks

@Eitasanswer

Great response. Remember everyone, these guidelines were from 3 years ago. I very much doubt these will be the exact guidelines when they implement it.

Why? Well, if someone had a sexual assault conviction on 4 children in 2011, they won't care? But a shoplifting in 2021 they DO care?

Again, there must be a good reason it was not rolled out, and truthfully, we still don't even know if it ever will. (In its current form).

Does anyone know the reason it hasn't?

1. This original rollout for this was for 2022, has been delayed for about 5 years now. Still not being implemented with no concrete deadline in place.

2. I've done extensive research on this.

Commission Delegated Decision (EU) 2023/2424 of 28 July 2023, published in the EU’s Official Journal on October 31, 2023. Its title says it is “specifying the content and format of the questions” for ETIAS. Eur-Lex
The key provision is Article 2(1). It says:

The applicant shall be presented with the following questions:

The form is required to ask:

Have you been convicted in the last 15 years of one or more of the criminal offences listed below?

And separately:

Have you been convicted in the last 25 years for terrorist offences?

so apparently if your conviction date (not charged) is older than 15 years, you don't have to enter it.

It is not in operation yet (according to the website)

https://travel-europe.europa.eu/etias

ETIAS is currently not in operation and no applications for travel authorisations are collected at this point.
The European Union will inform about the specific date for the start of ETIAS several months prior to its launch.

DO NOT APPLY to this with a criminal record. Once you TELL them you have a record, you have NO idea who this will be shared with (the US? Australia?)

Get a Pardon NOW. HIDE THE RECORD.

We have no idea what this will mean for people with records, but it would be as mistake to share your record, when you have plenty of time to get a pardon.
