This ICE memo ties into the US immigration family to include waiver cases. This memo contains essentially the same policy that was used by Obama during his administration. This memo further reinforces my statement when I previously said that Biden MAY follow a similar path as Obama.

Thank you my Brotha for finally acknowledging that everyone is entitled to their own opinion. I have been saying this for oh I dunno...maybe 5 years now. Thank you for finally acknowledging it. I also respect the fact that you have your opinion and you are completely entitled to the same as well. I also support you in this endeavour and I would stand by your side if someone here on this platform attacked you for your beliefs.

Why don't you keep the posts to something your either HAVE, something you have DONE, or something that's ACTUALLY HAPPENED. "We are going to be getting a secret handbook" sounds unprofessional and fictional.
Back to the ICE memo. I don't think its relevant to a single waiver client. But your entitled to your opinion.
@John no one ever said anything about a secret handbook or documents. CBP has certain internal policies, procedural manuals, and other information that they do not release to the general public. I do not know if this qualifies for the title of secret document. We have been provided copies of some of this material that we use in preparing our waiver cases. I will only say that certain DHS sources have gives us copies of some of this material. Remember, I have years of experience working for the system and have made numerous contacts/ friends over the years that still work for certain US govt agencies. People that know people that know other people in agencies.
Please do not troll this reply since you have no idea whom I know that work for American govt agencies. Nor do you know what material that we possess and use in conjunction with preparing waiver cases. You only know what I choose to release on this forum. Remember, you have already been schooled once about your behaviour. Btw the rejection letter is used in conjunction with the aforementioned manuals, policies, regulations, and codes

Any 4 page rejection letter is the best indication of what Homeland Security is looking for. They make it clear. Again, there is no secret handbook, or documents. Just Homeland Security issued guidelines which EVERY rejection letter contains, regardless of why the person it denied.
@ John, The material that we may possibly be able to gain access to has already been in place before Biden took office. Again, I am unsure if we are able to get it or not. I will just have to wait and see what happens in terms of obtaining it. We already have the criteria that CBP uses whether to approve or deny a waiver case. Hence, this will be from the same source. The only delay is the change in administration and switching around of personnel at DHS. Again, we have our fingers crossed.
@Ken, thanks for the explanation. I actually think they are just telling ICE they need to stop deporting people for 100 days so they can put their own people an policies in place and then adjudicate under whatever the Biden Administration deems to be their policies.

Biden hasn't decided ANYTHING in terms of changes to Homeland Security, especially waivers, so how can you possibly getting access to something that doesn't even exist yet? Its like saying "I already know what Bidens post-presidential book is going to say" when he hasn't actually LIVED it or written it. Yes, it will exist. But no way you could "access" the manuscript until he has WRITTEN it.
Oh well, it simple. Obama made it a priority for ICE to remove people that either had criminality or serious immigration violations. There was a case that we did that involved a family that had previously overstayed for 15 years in Seattle. ICE found the family but did not remove them because of the Obama directive. This was based on the fact that the family only had an overstay issue and no criminality. The family came back to Canada afterwards and came in for a waiver. I told them that they could either wait out the 10-year ban or we could file a waiver. They already had 1.5 years to go and I said that it would save them money to just wait out the time. Well, they waited and went back to the USA. Mr Archer got them an E-2 visa and now they are in the USA still on the E-2 and do not need a waiver.
Anyway, the point is that Obama was very pro-immigration and this includes waiver cases. They were not as hard on trafficking cases as much. However, they were very hard on Fraud and those cases took much longer to get cleared. Trump got in and was harder on Overstays, and Trafficking cases but not as hard on Fraud offences. Hence, I suspect that Biden will do the same as Obama and certain waiver cases may not be as hard to clear under his administration. This ties into waiver cases in the fact that certain offences may not be as hard to clear under this new administration. This ICE memo is just the starting point.
Also, we may soon be getting access to some additional material from certain in-house sources that can be used on waiver cases. I will be happy to share certain parts here on this forum if we are successful in gaining access to the information. It is information that is not open to the public.
Also, note that we do much more than just waiver cases.

@Ken can you explain why you think its related? I am not seeing anything to do with applicability to waivers, especially since ICE has its own budget and is seperate. Maybe some clarification so people looking for waiver information can understand what your "linking".
