Expedited Removals & 5 Year Bans

KSCOTTposted 3 years ago

We are going to do a video on 5 year bans, and the reasons why they are issued. I think we will touch on why they may stay around to haunt you after the 5 years are up. I am thinking that we may also cover the criteria that CBP uses to actually approve waivers. I may also show the actual criteria sheet that is used by CBP. The harder part is trying to balance giving people some interesting info and the Discount Waivers trying to obtain additional knowledge. However, we have a solution to address this issue. We use this material to maintain our 98% - 99% success rate.

@Ken Scott. So where is the video on 5 year bans?

Your secret locations are at 80% and 75% capacity? Why is there a "capacity"?

6 months to "prepare" a case? Why? A lawyer can prepare a complex criminal case for trial in a couple of months, but you can't prepare a case that can't even be handed in anyways, for MONTHS? Do you really think anything you are saying makes you look credible? "I am swamped and slow" which we all know is fake, makes you look disingenuous, and like you are warning everyone "if I do anything, its going to be slow".

So based on how ridiculous you look here, you are "swamped"? LOL Barely anyone reads this page, and if they do, they will find out you make a lot of promises, and know very little about pardons other than what you read online. Also, your not in Canada.

Job hunt Ken. That would be the smart move for you. In the meantime....lets see the video you promised on bans.

Apparently, I need to provide my definition of busy. Busy means that we are running at 80% capacity or so in regard to preparing and/or submitting border cases. Some cases do not require a waiver. Busy means that we are running about 75% regarding pardon cases. J.R. still does not seem to understand what we are doing and more. We can easily operate and function on a certain number of new cases monthly to add into the collection. We have had a drop in the number of small fish cases, but the bigger fish ones have increased after Biden got elected.

J.R. is not aware that essential workers can still file at the border. Hence, these cases and the ones needing specialized care have received a higher level of focus from us for the moment. The work still has to be done whether COVID-19 is spiking or not. We just got 2 overly complex sex assault cases that are going to take at least a year to document and develop the rehabilitation. We also received 6 cases referred from A.C. Khan on former cross border traffickers and such. These cases will take at least 6 months to properly document.

Anyway, the point is that there is still a lot of work that has to be done on these cases in a timely manner. It is his choice if he chooses to work from his lower Manhattan location. It also should not matter to him our case volume. Some people are more focused on COVID-19, but the economy is still going strong for some people depending on your industry. People can call our numbers pretty much any day and will get me on the phone and/or come into our locations…COVID-19 or not.

@Ken Scott

Covid is spiking. The United States this week SET A DAILY RECORD. BC is doing badly. Alberta Worse. Ontario has sections in lockdown.

US Thanksgiving is today, and we KNOW this will make covid WORSE, not better.

Your not "busy" from Canada, and NO ONE thinks the border will be open December 21st.

Seriously, at LEAST watch Canadian news, if your not going to be present in the country.

J Rogers replied 3 years ago   #12

Well J.R. the only thing that you got correct in post #10 was about the Estonian women not being spotty. Also, obviously you need to change your senior citizen/Sean Spicer type bifocals, since I am clearly wearing a different suit in most of my YouTube videos. You also clearly have not been to Estonia because you would know that you can get excellent Wi-Fi even in the forests there. Again, just keep making you own statements against your fellow Discount Waiver Companies in Ontario. I understand that you are fighting with them and the mice over scraps of bread dropping to the floor there.

Now I am starting to wonder if you are even there in Ontario now since you seem a lot like a New Yorker. I have to give it to you when you previously said that I had a "Eureka" moment. I have now figured that this online "New York" persona is either just your online persona, or you in your natural lower Manhattan environment. It makes sense to me now since you are the total 360 opposite on the phone...like a typical New Yorker when you speak to them face to face.

Anyway, let us stick o the facts here. You choose to name these companies and choose to do the opposite. You obviously have a lot of free time on your hands to do this. I clearly do not since we have the 24 projects on the go. We have gotten flooded with business after the Biden election since people are anticipating the borders reopening soon. Covid is helping us catch up on our case work since it might be challenging getting all of these cases out on Dec 21st if they announce that the border would reopen on that date.

@Ken Scott

You are correct, I can not "force" you to be "unafraid".

Here is where we stand.

John Rogers sees fraud, he calls it out immediately, he names the offenders name, and name of company. Not only backs it up, but steer others clear, and attempts to get clients money back by shaming that company publicly.

Ken Scott sees fraud, he will call it "Ontario Discount Pardon Company", regardless of location, and for his own protection, he will allow people to possibly use that company. Because a scammer MIGHT find his secret location in England...during a pandemic, and serve him with papers. He could lose the sunglasses, the hat, and that backpack we saw him in, leaving him with only the suit. I believe YouTube intro music is exempt from seizure in the Commonwealth.

The last thing I want to see is Ken forced to flee to Estonia, where the internet is spotty, but luckily the women are not.

J Rogers replied 3 years ago   #10

Well J.R. you are not in a position to make demands or policy. You conduct your business as you see fit and we will do likewise. Like it or not, we choose not to mention these individuals by name since it serves us no benefit whatsover. No need to elaborate on this issue since I have already made my decision.

@Ken Scott the point is you are helping "scam artists" when you don't name them. Worse, you waste all of our time by making vague accusations without specific details. When, who, where, why. "I am worried about being sued" empowers THEM, and makes you look weak and scared.

"Some company in Ontario" sounds as dumb as "the deep state".

You bring "them" up constantly but never give us real MEAT. I mention names all the time and NO consequences.

Name names, or just don't bring the topic up.

J Rogers replied 3 years ago   #8

Well J.R. you were being civil, but you are slipping towards being non civil again. Now it could also be me, but some Ontarians tend to be New York like in my opinion. Anyway, it is not a matter of fear but one of only common sense. It does me no good to name a competitor by name and write derogatory information that I have no actual or documented proof of its authenticity. It is my choice to not name the companies by name unless I have documented proof. I suppose that I can use sworn affidavits from their former clients and state my reasoning is based on the aforementioned affidavits.

You can argue with these companies, lawyers, and administrators if you wish but I have no desire to waste time as such. I win by out maneuvering and winning the argument based on pure logic and documented proven undisputable facts only. Hence, this is why we have a 98-99% success rate on our border cases.
However, the main point here is that it is simply a waste of time for us on a business standpoint. No need to bash them when I can just put them out of business using attrition and various legal methods. Again, I have a new associate that was fired by an Ontario Discount Waiver Company that has direct knowledge regarding how these DWCs operate there.

Btw this is really getting old, but you have no idea where I am, our locations and ALL the services that we offer to people. I still cannot fully figure out why you care that I have 3 properties fully paid off(no mortgage) in 3 countries(US, Canada, England & eventually Estonia), and can choose where to stay when I travel. Again, it is not relevant where I am since I have locations in 4 countries for people. I could rag on you about your alleged "fingerprinting accreditation" since Jennifer's name only appears on both of them. However, for the moment, I choose not to do this.

However, the purpose of the forum is to share information in a civil and efficient manner. It could also be that you just have a natural New York type personality?? If this is the case, then I can understand and can resuming engaging with you in an arrogant condescending belittling manner if you wish. The choice is yours and I respectively encourage you to remain civil and professional.

@KenScott

When you do a video, or write a post, you are ONLY in legal jeopardy when you say something false. Anyone can still "sue" for perceived defamation, but the publicity that this garners is more harmful than helpful.

Dominion Pardons uses a tactic where they send an invoice to a client, whether they started a pardon or not, because of a phone call. They use a "accounts receivable" company in Manitoba to "coerce" people into paying the invoice because their "account manager" is a woman who pretends she is going to ruin the applicants CREDIT if they do not pay. Its a complete scam.

I have called the credit company, I have NAMED them and the person who is the account manager. I have named the owner of Dominion Pardons Richard Breslin, and I did a waiver for someone who knows him well and claims he has a criminal record. Richard Breslin also ran a scammy passport business under his son's name.

Everything I said here is 100% true. If any of these parties serve me with papers, I will publish them and all these facts all over the web. I'll go on his Facebook page, I will go on his parents page, his wife's, his friends. And I will go to court, defend myself, embarrass ANY lawyer, and get him MORE negative publicity.

If I am willing to do THIS, then YOU can name names. Also you are not even in Canada. Seriously Ken, don't half-ass it. NAMES.

I am not afraid. Why are you?

J Rogers replied 3 years ago   #6

Well J. R. I can appreciate that you are at seemingly civil and will thus be the same. However, I am unsure it is not so much as giving trade secrets since it is more on the scale of info sharing. It is true that we offer services that other waiver businesses and lawyers choose not to do. I will not bore anyone here with details, but it is because our clientele expect/demand and are entitled to such treatment.

There is no way on this planet will I ask a $6800 waiver client to do any work on his case period. The most that he has to do is fingerprints (which we cover for him), provide us proof of income, breathe, pay the govt fee and sign documents. We cover everything else to include developing and documenting his rehabilitation, counselling and more. This also includes him seeing our psychologist or counsellor if needed.

He will not even have to drive to the border since one of my boyz will be taking clients to the border in one of his limousines after the border reopens from COVID-19. This is nothing new since this had already been announced on our Facebook back in May 2020.

Anyway, I will put this video topic on hold for the moment because I will do a much more relevant one. The next one will be on waiver related scams used lawyers, Enhanced Fee Waiver Companies & Discount Waiver Companies. We have been seeing a new trend slowly taking place now regarding the aforementioned businesses.

J.R. you are invited to partake in this video and voice your comments on this topic in this video. I know that you have mentioned these crooked companies by name before, and your input in this video could help out members in this forum. I just do not want to name any of these companies by name due to them trying to claim defamation in a civil suit.

I now have a new associate that was wrongly terminated from an Ontario Discount Waiver Company and is another one of my advisors. He was the one that encouraged us to release our latest Canadian Pardon video. The gentleman is also pushing us to do the upcoming pardon & waiver scam video.

@Magnus yes J.R. is correct about them accepting packets for critical workers for the moment.

@KenScott

Your desire to share info vs "giving away trade secrets" is understandable. But both Michelle and I have seen waivers you have done, and we both choose to NOT emulate your "style" of letter writing. Most other companies don't even write the letters for the client, so you don't have to worry.

As for the "criteria", it is there in EVERY rejection letter Homeland Security writes. Waivers that are rejected give all the "secrets" to Homeland Security's "criteria".

One of the reasons I would go to the airport was to connect with people who I thought WOULD be rejected, and we going to file anyway. I want to see the letters they get. During the airport being open period, I would see a couple of letters on average a week.

As I tell clients. "An approved waiver gives NO feedback. A rejected waiver gives valuable information."

So share away. People who do waivers on their own may have never seen a rejection letter, so your video, if done well, could be very informative.

J Rogers replied 3 years ago   #4

@Magnus

Only for "essential workers" (like Truck drivers), already crossing the border. No one else.

J Rogers replied 3 years ago   #3

Are any POEs currently accepting waiver packages? This has probably been answered somewhere on this forum already but I’m going to guess the answer is no waivers are being accepted.

Magnus replied 3 years ago   #2

@Ken Scott. Great topic choice. Why don't you "post" some documents here as well (if you can) so we can "pre-read" and then it will be easier to follow your video?
