A father called me to ask some questions about a waiver his son had filed.
The son had a simple misrepresentation, but it was less than 3 years ago.

Unfortunately, Homeland Security had ENCOURAGED them to apply for a Waiver AND an I-212.

That is $585 + $930 USD. And I am pretty sure it is not going to be approved. And I don't see how an I-
212 is even warranted.
Remember. You would not ask a police officer for legal advice right after he arrested you. Do not rely on Homeland Security for advice either.

Canadians are pretty honest and rule abiding people. The problem is that Homeland Security GENERALLY don't have that much knowledge about adjudication or even WHO is approved.

Here is a perfect example.
They closed this clients file because "he did not respond in the 87 days" but look at the timeline. He responded in 10 days. They asked for court documents, and a further explanation, and we gave them that. But they close the file anyways. $675USD to re-open. This is the third client this has happened to since May 2021. As I explained, its CHEAPER to just re-file and include the "extra" documents they wanted than to re-open the file. I will do the work for free.

Frustrating!!!

@JRogers they are definitely giving false information and non realistic advice. Worse part is there is no accountability or consequences for what they are doing. So sad.

He "lied" at the border. Its been less than 3 years. The explanation will be "insufficient time has elapsed to have a change of character".

I hope I am wrong of course.

@JRogers, why do you think it is not going to be approved? Is it a 3yrs or 10yrs ban? Does it mean if you don't wait till the ban is over you cannot be approved? Please explain further. Thank you
