I cannot be 100% sure. I assume when you "overstay" or "work illegally" and then do a waiver, and then they say "you do not need advance permission" then you SHOULD be cleared to apply for a Nexus or Fast card.

Unlike a lot of people/organizations that do waivers, I get a LOT of "immigration issues" probably at least 30% or higher. So many of the September Letters I get are like this. The problem is I lose touch with most of the clients in this category because
-They do not need a pardon either
-They do not need another waiver,

So unlike most clients, they have no need to stay in touch. So if they DO apply for a Fast Card or Nexus Card, I would not know.

If the "record" is not criminal in nature but rather an immigration related violation such as an overstay does that still constitute a "record" or does a September Letter basically wipe out the "record" of the overstay?

Great question.

Technically, you should be able to get both. Here is the problem. Sometimes you get a September Letter when you HAVE a record. Sometimes you do NOT have a record, are deemed inadmissible for some other reason, and then get a September Letter.

My best GUESS would be if there is a record, then NO. If there is NO record, then yes. But I am only guessing, I am not 100% sure and I would need someone to actually apply and report back to be sure.

The other problem is TODAY we are talking about THIS administration. They can be inconsistent as well.

No. You cannot get a Nexus card when you are on the waiver program...or a FAST card
