Post real application stories here. Not "A guy told me" or "a few of my clients" but specific client experiences so others can see accurately what is happening.

There are rare exceptions, but whether you file a waiver, or a waiver AND an I-212 you simply get a waiver in return. That's why I tell clients to wait. Its an extra $930USD for the exact same waiver.

Sorry, that was meant for the response below

Sorry June 14th, not 16th.

Replies (recent first):

@Magnus I wasn’t a Canadian citizen and had a visitor visa. I don’t know how it worked really. They canceled my visa and barred me from entering for 5 years. When I became a citizen, I was told that I would need a waiver but I would need to wait 5 years.

And lol I feel like they’re getting slower and slower. I heard they would take over a year with the paper so for esafe to be taking so long is worrisome.

Thanks for the reply @SarahB.

I haven’t filed an application yet. I had an overstay from about 6-7 years ago and I’ll probably file an application this year. Seems they’re taking longer these days so hopefully by the time I file mine it won’t be a 6 month wait. Lol.

If you overstayed for 6 months how’d they ban you for 5 years? I thought that was just a 3 year ban and if you overstayed a year or more it’s a 10 year ban.

Magnus replied 1 year ago   #542

@Magnus I needed a waiver because I overstayed by 6 months. This was back in 2012. My ban was five years. I waited an additional 5 years before applying.

Do you have an application pending and if so, what are your circumstances?

SarahB replied 1 year ago   #541

@SarahB super congratulations and 5 years on top of it! That’s awesome!

May I ask what you needed a waiver for and how long ago was your ban from the US?

Magnus replied 1 year ago   #540

My waiver is here! 5 years first time applicant. I’m so excited!

@J Rogers @JerryT congratulations on your approvals. I hope mine show up soon. Soon they’d be into September waivers so I’m keeping my fingers crossed since I submitted August 31st.

5 year waiver. This client had a waiver as a landed immigrant, (very unusual) for 1 year and this was a re-application for him, first time he had dealt with me. He was a misrepresentation case, where the lawyers doing his paperwork for visas had really made the mistake, not him.
Note like JerryT (above post) he went to the border August 31. Congratulations to both people.

@Magnus
My TN valid for 3 year, but my waiver is 2 years

Nathan replied 1 year ago   #535

@Nathan why was your TN visa only for 2 years? It’s a visa for 3 years that can be renewed indefinitely. Just curious as to why yours is only 2 years.

Magnus replied 1 year ago   #534

@Joe
My first waiver was B1/2 1 year and second one I specifically asked for TN and granted me for 2 year (with TN), I have attached my degree certificate/transcript and a letter requesting for TN to work in US

Nathan replied 1 year ago   #533

@JerryT ok. Hopefully we both hear back from them soon.

SarahB replied 1 year ago   #532

I did not request for an update. Im not really in a rush anymore. I'd be happy if I get approved in the middle of this year.

PatientlyWaiting416 replied 1 year ago   #531

@SarahB I also had my application uploaded to the ARO on Aug 31 and have not received any further info. Thios would be for my 4th Approval (have
had 1 - 1yr and 2 - 5yr waivers). Impatiently Waiting...

JerryT replied 1 year ago   #530

@J Rogers Not a single waiver approved this week? I’ve been waiting since August 31st

SarahB replied 1 year ago   #529

@J Rogers yes I understand. It all boils down to if a person without the so called slam dunk case, wants an opportunity to travel to the US they submit their application and hope they are approved.

Tiffany replied 1 year ago   #528

@Tiffany
If they say "no" then they do. They want to make the decision hard to appeal.

Remember, when they decide "no" then they bolster that by adding up as many factors as they can to justify the decision.

In reality it is not ALWAYS a factor.

J Rogers replied 1 year ago   #527

@J Rogers I tell you reading everything on here has really helped me put much into perspective. On the sentencing question asked earlier do they add the probation with whatever sentence a person gets as an overall sentence?

Tiffany replied 1 year ago   #526

@DT

Difficult, not impossible. The circumstances matter as well. If I pull out a pocket knife and say "give me your iphone" that is armed robbery. Much different than taking a gun into a bank. I would say 2012 armed robbery, 2 year sentence, that is "likely" a 1 year waiver IF the personal letter was done properly. 5 year less likely, also a possible "no".

J Rogers replied 1 year ago   #525

@DT that’s an interesting question. I have the same sentence and that would be a bummer if this is what it’s considered since I have seen here that it’s difficult to get a waiver if you are sentenced to more than 3 years.
